California Used Car Lemon Law Fact Sheet

If you bought a used, pre-owned or certified car, truck, van, SUV or other vehicle that is still covered by a manufacturer’s warranty, then you may be protected under both the California Used Car Lemon Law and the Federal Used Car Lemon Law.

The California Used Car Lemon Law provides legal protection for anyone that purchases or leases a used car, or any other used vehicle that is still covered by a manufacturer’s original factory warranty from being stuck owning a lemon. The Used Car Lemon Law also covers demonstrator (demo) Vehicles, Vehicles previously repurchased under the lemon law and resold with a manufacturer’s warranty, and any vehicle that has been certified and given an extended warranty that increases the length of the manufacturer’s original warranty. This law provides the owners of defective vehicles that meet the requirements of the Used Car Lemon Law with compensation in the form of a refund, a replacement or cash compensation.

Cars Covered By California Used Car Lemon Law Include:

  • Used cars or vehicles bought and used primarily for personal, family or household purposes.
  • Used cars or vehicles with a gross weight that is below 10,000 pounds and used primarily for business purposes where 5 or fewer vehicles are registered to the company.
  • Used cars or vehicles that are sold with a written warranty.
  • Lemon cars or vehicles that are repurchased by a manufacturer and then resold to consumers with a manufacturer’s warranty covering the defects.

Statutory Warranty Length

California Used Car Lemon Law applies for the entire period of a manufacturer’s warranty and extends after the original warranty if the vehicle has been certified or includes a Manufacturer’s extended warranty. This means, for example, that if a vehicle is covered by a 3 year warranty and a defect or nonconformity is discovered after 2 years from the warranty start date (typically the date the vehicle was originally sold unless the vehicle has a manufacturer’s extended warranty), then the manufacturer will be required by law to either repurchase or replace the vehicle, or to compensate the owner of the defective vehicle providing that the defects or nonconformities meet the requirements of the Used Car Lemon Law and the manufacturer was given a reasonable number of attempts to repair the car or vehicle.

There is a 4 year statute of limitations to file a lawsuit for breach of warranty.

A Manufacturer’s Duty to Repair

The California Used Car Lemon Law provides the manufacturer and its authorized dealers with a reasonable number of attempts to repair the defects or nonconformities in a used car or vehicle under warranty before they are required to buy back a vehicle or compensate the owner. A reasonable number of opportunities may be exceeded if the vehicle has experienced:

  • 1 to 2 repair attempts for a serious safety defect such as a brake failure.
  • 2 or more repairs attempts where the defect recurs and is likely to cause death or serious bodily injury if the vehicle is continued to be driven.
  • The same nonconformity or defect has been attempted to be repaired 4 or more times.
  • The vehicle is in for repairs for any number of defects or nonconformities by the manufacturer or its agents for a total of 30 or more days.

Exceptions When a Manufacturer or Its Agents Will Not Be Required To Make a Refund or Replacement

California Used Car Lemon Law Does Not Apply If:

  • The problems that a car or vehicle is experiencing is caused by abuse after the vehicle was delivered to the consumer.
  • The terms of the vehicle’s warranty for maintenance and proper use were not followed properly.

What Should You Do As A Consumer If You Realize or Suspect That Your Used Car May Be A Lemon?

  • Contact a California Lemon Law Attorney to understand your rights and to see what options may be available to you. Manufacturers often fight individual Lemon Law claims and most California Used Car Lemon Law Lawyers work on a contingency basis, so not only will you not have to pay any out of pocket fees, but you will have the best chance for success.
  • Get and keep a copy of the repair order clearly indicating what problem your car has been repaired for.
  • Make sure you have a copy of every repair order clearly indicating what problems your car has been repaired for and keep them in a safe place.
  • Directly notify the manufacturer of your car or vehicle of the defects and nonconformities that your car has experienced.
  • If the manufacturer of your vehicle maintains a state-certified arbitration program, you may submit the warranty dispute to the arbitration program listed, but you should contact a California Lemon Law Attorney before going to Arbitration as the outcome of the arbitration could hurt your chances of receiving proper compensation.

In addition to the Used Car Lemon Law, You may also be protected by law if you feel that you have been deceived by a dealership regarding repairs made to a vehicle prior to its sale or the condition of the used vehicle that you purchased. Certified cars trucks, SUVs and other vehicles may also be improperly certified according to California Used Car Lemon Law and you should have an experienced California Lemon Law or Auto Fraud Attorney review your documents as soon as possible if you are having problems with your certified used car or vehicle.

There are two main types of car warranty.

The chief difference is that MBI providers are regulated by the the Financial Conduct Authority (FCA). That means that you’d be able to use the Financial Ombudsman service to help remedy any complaints with the provider.

Service and repair plans aren’t regulated, so you won’t benefit from this protection. But you may have some recourse with the Motor Ombudsman.

    After dedicating an afternoon (or more) to test driving, negotiating, and completing a pile of paperwork for your shiny new car, don’t be surprised if a bubble-bursting finance manager at the dealer gives a compelling pitch for an extended warranty. It is for your peace of mind, right? Well, not really.

    The last-ditch effort to sell you a warranty, or various other unnecessary services, is the dealership’s final assault on your checkbook before you tuck it securely away and drive off. Sure, the pitch is convincing: Should an expensive repair be necessary after the factory warranty ends, you’d be protected. No one wants a big, financial surprise, nor wishes to be stranded roadside. (Read Watch for These Dealer Sales Pitches . )

    But breathe deep and think this through. A survey conducted by the Consumer Reports National Research Center in late 2013 found that 55 percent of owners who purchased an extended warranty hadn’t used it for repairs during the lifetime of the policy. And, on average, those who did use it spent hundreds more for the coverage than they saved in repair costs.

    Among survey participants who used their policy, the median out-of-pocket savings on repairs covered by extended warranties for all brands was $837. Based on a $1,214 average initial cost, that works out to a net loss of more than $375. Factoring those who didn’t use their policy, the median savings was zero. And that may have something to do with why satisfaction with auto­mobile extended warranties is among the lower rated of all products and services surveyed by Consumer Reports, and why only about a quarter of respondents said they would definitely get it again.

    Used Car Lemon Law

    California’s lemon law statute, the Song-Beverly Consumer Warranty Act, protects used cars in several different ways. First, all used automobiles that are purchased or leased from a California car dealership during the original manufacturer’s warranty period qualify for protection under the new car lemon law. So if you purchased a used car, truck, or SUV in the Golden State before it was either 3 years old or had 36,000 miles on the odometer (or if it otherwise is still covered under the original manufacturer’s warranty), then check this site’s California new car lemon law page to see if you are entitled to a lemon law buyback.

    Used Automobiles Sold With a Dealer Warranty Are Covered Under the Used Car Lemon Law

    Unlike some other states, in California used cars qualify for protection under the used car lemon law only if they are sold with a warranty. As stated above, if they are covered by the manufacturer’s warranty (which is typically 3 years/36,000 miles, but can be more for some manufacturers), then they may still qualify for coverage under the new car lemon law. If no manufacturer’s warranty came with the vehicle, then the dealer must have provided a warranty in order for the used car lemon law to apply.

    Dealers’ warranties are typically limited to periods between 30 days to 3 months, but may be longer depending on the dealership. You can tell whether or not you received a dealer warranty by looking at the document called the Buyer’s Guide. Federal law mandates that Buyer’s Guides must be prominently displayed on used automobiles (usually in one of the windows) while they are being offered for sale. The Buyer’s Guide has two boxes on it, one labeled “Warranty” and the other “As Is.” If the warranty box is checked, then your vehicle came with a dealer warranty.     So-Called “Extended Warranties” Are Not Actually Warranties

    Many consumers purchase so-called “extended warranties” with their used cars. Unfortunately however, for the purposes of the California lemon law these are not warranties at all, but “service contracts.” The California lemon law was designed to ensure that car dealerships and manufacturers honor the warranties that they offer on their goods. But “extended warranties” are not the dealer’s promise that the vehicle is in good condition; rather, they are a third party’s promise to repair the vehicle if it breaks down. So unfortunately, if your vehicle only came with an “extended warranty,” then you probably do not qualify for coverage under California’s used car lemon law.

    The only known exception to this rule is service contracts that require you to take your used car back to the selling dealer so that it can perform all of the repairs. If your “extended warranty” requires that the selling dealer fix your vehicle whenever there is a problem, then you should to talk to an expert lemon law attorney to find out whether it qualifies as a warranty under California’s used car lemon law.

    How the Used Car Lemon Law Protects You if You Received a Dealer Warranty

    If the dealer provided a warranty with your used car, then you are protected in two significant ways. First, during the term of the warranty you are protected in much the same way as the new car lemon law for the parts and components covered by the warranty. Dealer warranties usually cover only certain parts and components, but if one of those components fails causing a substantial defect then the dealer must fix it within a reasonable number of attempts or offer you a lemon law buyback if it is unable to do so.

    Second, for all used cars sold with a dealer warranty of any kind, California’s lemon law statute imposes an “implied warranty of merchantability.” The implied warranty of merchantability lasts for a minimum of 30 days. If the dealer’s warranty is longer than 30 days, then the implied warranty of merchantability lasts for same period of time as the dealer’s warranty.

    So what good is the implied warranty of merchantability? The main benefit of the implied warranty of merchantability is that it is not limited to the specific parts and components covered by the dealer’s warranty. It covers the entire vehicle. That being said, it is a very basic warranty. It only requires that your used car provide you with reliable, safe transportation during the warranty period. It won’t cover a malfunctioning radio or sound system because that type of defect does not prevent your use of the vehicle. But if your vehicle’s door locks stop working (or if anything else goes wrong preventing your safe, reliable use of the vehicle) the implied warranty of merchantability gives you a right to obtain free repairs or a refund during the warranty period regardless of whether or not the locks are covered by the dealer’s warranty.

    Under the implied warranty of merchantability, you can also avoid paying deductible and co-payments that might otherwise be required under the dealer’s warranty. For example, some dealers offer 30 day warranties on used car engines, but the warranties require that you pay 50% (or some other portion) of the parts and/or labor. But if your engine completely fails (or the implied warranty of merchantability is implicated in some other way), then the implied warranty of merchantability can force the dealer to provide repairs for free without any charge to you.

    If you purchased a used car with a dealer warranty that turns out to be a lemon, you should call a qualified lemon law attorney to discuss your case, regardless of whether or not the defect is specifically covered by the dealer’s warranty. In spite of what the dealer is telling you, you may be entitled to free repairs or a full refund.

    The possibility of having to fork out for a major repair on a car is a fact of life. And the older cars get, the more likely they are to break down.

    Car warranty provider Warranty Direct believes 43 per cent of cars between four and nine years old break down each year. The average cost of repair is £376.19. What’s the best way to mitigate against paying for these? And do aftermarket warranties make sense?

    Owners of older vehicles broadly have three choices. They can wait until the car goes wrong and take it on the chin, extend the warranty via the manufacturer, or go for a bespoke aftermarket guarantee. The car manufacturer option can be pricey; the aftermarket option should be treated with greater suspicion; the no-warranty option requires you to have the funds for bills that could run into four figures.

    Trevor Barkham, the AA’s technical design team leader, explained: “Manufacturer and aftermarket differ completely. Manufacturer warranties tend to be as good as the original guarantee but generally they won’t cover wear and tear items as standard. Aftermarket warranties will cover wear and tear items but there is a lot of choice and some are better than others.”

    Trevor puts a reasonable case for not going down the warranty route: “Anything that’s going to go wrong due to a manufacturer defect probably will have within the first three years,” he says. So assuming you’ve got a pretty good feel for your car’s susceptibility to niggling faults, and by looking at online reliability surveys, you’re probably in a good position to know whether a warranty will pay for itself.

    Used Car Lemon Law

    California’s lemon law statute, the Song-Beverly Consumer Warranty Act, protects used cars in several different ways. First, all used automobiles that are purchased or leased from a California car dealership during the original manufacturer’s warranty period qualify for protection under the new car lemon law. So if you purchased a used car, truck, or SUV in the Golden State before it was either 3 years old or had 36,000 miles on the odometer (or if it otherwise is still covered under the original manufacturer’s warranty), then check this site’s California new car lemon law page to see if you are entitled to a lemon law buyback.

    Used Automobiles Sold With a Dealer Warranty Are Covered Under the Used Car Lemon Law

    Unlike some other states, in California used cars qualify for protection under the used car lemon law only if they are sold with a warranty. As stated above, if they are covered by the manufacturer’s warranty (which is typically 3 years/36,000 miles, but can be more for some manufacturers), then they may still qualify for coverage under the new car lemon law. If no manufacturer’s warranty came with the vehicle, then the dealer must have provided a warranty in order for the used car lemon law to apply.

    Dealers’ warranties are typically limited to periods between 30 days to 3 months, but may be longer depending on the dealership. You can tell whether or not you received a dealer warranty by looking at the document called the Buyer’s Guide. Federal law mandates that Buyer’s Guides must be prominently displayed on used automobiles (usually in one of the windows) while they are being offered for sale. The Buyer’s Guide has two boxes on it, one labeled “Warranty” and the other “As Is.” If the warranty box is checked, then your vehicle came with a dealer warranty.     So-Called “Extended Warranties” Are Not Actually Warranties

    Many consumers purchase so-called “extended warranties” with their used cars. Unfortunately however, for the purposes of the California lemon law these are not warranties at all, but “service contracts.” The California lemon law was designed to ensure that car dealerships and manufacturers honor the warranties that they offer on their goods. But “extended warranties” are not the dealer’s promise that the vehicle is in good condition; rather, they are a third party’s promise to repair the vehicle if it breaks down. So unfortunately, if your vehicle only came with an “extended warranty,” then you probably do not qualify for coverage under California’s used car lemon law.

    The only known exception to this rule is service contracts that require you to take your used car back to the selling dealer so that it can perform all of the repairs. If your “extended warranty” requires that the selling dealer fix your vehicle whenever there is a problem, then you should to talk to an expert lemon law attorney to find out whether it qualifies as a warranty under California’s used car lemon law.

    How the Used Car Lemon Law Protects You if You Received a Dealer Warranty

    If the dealer provided a warranty with your used car, then you are protected in two significant ways. First, during the term of the warranty you are protected in much the same way as the new car lemon law for the parts and components covered by the warranty. Dealer warranties usually cover only certain parts and components, but if one of those components fails causing a substantial defect then the dealer must fix it within a reasonable number of attempts or offer you a lemon law buyback if it is unable to do so.

    Second, for all used cars sold with a dealer warranty of any kind, California’s lemon law statute imposes an “implied warranty of merchantability.” The implied warranty of merchantability lasts for a minimum of 30 days. If the dealer’s warranty is longer than 30 days, then the implied warranty of merchantability lasts for same period of time as the dealer’s warranty.

    So what good is the implied warranty of merchantability? The main benefit of the implied warranty of merchantability is that it is not limited to the specific parts and components covered by the dealer’s warranty. It covers the entire vehicle. That being said, it is a very basic warranty. It only requires that your used car provide you with reliable, safe transportation during the warranty period. It won’t cover a malfunctioning radio or sound system because that type of defect does not prevent your use of the vehicle. But if your vehicle’s door locks stop working (or if anything else goes wrong preventing your safe, reliable use of the vehicle) the implied warranty of merchantability gives you a right to obtain free repairs or a refund during the warranty period regardless of whether or not the locks are covered by the dealer’s warranty.

    Under the implied warranty of merchantability, you can also avoid paying deductible and co-payments that might otherwise be required under the dealer’s warranty. For example, some dealers offer 30 day warranties on used car engines, but the warranties require that you pay 50% (or some other portion) of the parts and/or labor. But if your engine completely fails (or the implied warranty of merchantability is implicated in some other way), then the implied warranty of merchantability can force the dealer to provide repairs for free without any charge to you.

    If you purchased a used car with a dealer warranty that turns out to be a lemon, you should call a qualified lemon law attorney to discuss your case, regardless of whether or not the defect is specifically covered by the dealer’s warranty. In spite of what the dealer is telling you, you may be entitled to free repairs or a full refund.

    What Is an Extended Warranty?

    A service contract, sometimes referred to as an extended warranty. is designed to offset repair costs after the purchase of a new or used vehicle.

    Not to be confused with a manufacturer’s warranty, extended warranties kick in after the expiration of the manufacturer’s bumper-to-bumper warranty. Extended warranties are sold as a separate contract, and—unlike a manufacturer’s warranty—are not included in the purchase price.

    Warranty Options Types

    An extended warranty will pick up repair coverage for a designated number of years AFTER you have reached either:

    • The allowed mileage on the original manufacturer’s warranty.

    OR

  • The number of years of the manufacturer’s warranty.
    • Example. 3 years or 36,000 miles.
  • An extended warranty can be purchased at a dealership at the time of sale, or after the sale but before the manufacturer s warranty has expired.*

    The two types of extended warranties are:

    • Dealership extended warranty .

    Dealership Extended Warranty

    • Frequently have specific requirements as to where your car is serviced .

    Like all service contracts, dealership warranties can differ in what they cover. Make sure you know if it extends bumper-to-bumper coverage past the manufacturer’s warranty or if it only covers a portion of the vehicle. such as repairs to the engine and drivetrain.

    If backed by the automaker, repairs must usually be made at a franchised dealership. Other stipulations such as scheduled servicing may also be required.

    Third-Party Extended Warranty

    A third-party extended warranty. sometimes referred to as an aftermarket warranty. is a service contract from an independent provider that has no direct business relationship with the auto manufacturer.

    Though it can be purchased at any time, it is best to purchase these warranties before the manufacturer s warranty has expired to get a cheaper rate.

    Each warranty package will offer different coverages; common coverage options include:

    • Titanium .
    • Platinum .
    • Gold .
    • Silver .
    • Bronze .

    An advantage of third-party warranties is that you often have more choices, which can help drive down the price.

    Understand The Carmaker’s Guarantee Before You Buy

    All warranties are not created equal (GM).

    New car warranties have come a long way in the past couple of decades. As the quality of Japanese cars began trumping the style and flash of Detroit, the local guys had to step up. Quality has been improving, but to give customers confidence in their cars, warranty coverage was also increased. Soon enough, the warranty became a significant part of the marketing and a major selling point for some cars.

    Who can forget Lee Iacocca in the 1980s pitching Chrysler, Dodge and Plymouth products by declaring they had the best warranty in the business and finishing with his famous line, “If you can find a better car, buy it.” More recently, Hyundai made a big splash when, emboldened by improved quality, it upped its powertrain coverage to 10 years or 100,000 miles and declared it “America’s Best Warranty.”

    Upping The Ante

    A warranty is insurance — and assurance — that your car will work at least through the stated period. A warranty may be included with the car, but, like insurance you buy from an agent, it’s not free. There are rooms full of actuaries and accountants constantly calculating outstanding and future warranty costs and figuring out an exact dollar amount they must add to the price of every car.

    Given their recent perilous issues with finance and viability, GM and Chrysler have both had to step up their warranty coverage and now offer powertrain coverage through five years or 100,000 miles. Despite the myriad recalls they have experienced recently, Toyota and Honda enjoy great consumer perception regarding quality, so their warranty coverage needn’t be best in class. When its sales in the U.S. tanked, Mitsubishi boosted its warranty coverage, which is now on par with Hyundai, covering the entire car for five years or 60,000 miles and the drivetrain for 10 years or 100,000 miles for most of its models.

    How Long?

    Today, all cars carry some kind of warranty, but not all are created equal. While three years or 36,000 miles (always calculated by whichever comes first, and often referred to as “3/36”) seems to be the de facto bumper-to-bumper warranty coverage, most luxury cars have a 4/50 warranty and still some other cars have 5/60. While many American and Japanese vehicles offer an additional powertrain warranty to as long as 10/100 — this covers the engine and transmission only — most European luxury brands do not extend powertrain coverage beyond the basic warranty period.

    Although there can be dubious value in buying a luxury car, you sometimes get more for your money in terms of warranty coverage. There are many Ford and Lincoln products that are essentially identical under the hood. But buy the Lincoln instead of the Ford and that 3/36 warranty becomes 4/50 and that 5/50 powertrain coverage becomes 6/70. There are similar bumps to the warranty coverage from luxury brands under the Toyota, GM, Nissan and Honda corporate umbrellas.

    What’s Covered and When?

    Some companies refer to the basic warranty as a bumper-to-bumper warranty because it covers virtually everything on the car (but typically not tires, which are covered by the tire manufacturer). Powertrain warranties usually cover the engine, transmission or transaxle, drive axles and related components, typically the lubricated internal parts. Rust-through warranties are just that — they cover corrosion that perforates the car, but surface rust doesn’t count.

    Emissions warranties are another issue entirely, primarily because both the Federal and state governments mandate that emission control equipment must work for a minimum period. These requirements vary from state to state, but most are much longer than the basic warranty. To give customers more confidence in the mostly uncharted waters of hybrid-electric and electric-only vehicles, battery packs and electric drive components in these cars typically carry much longer warranties than the rest of the car.

    Warranties cover defects in components and workmanship. But it’s often easier discussing what’s not covered and under which situations a warranty claim may be denied. Anything that is consumable or designed to wear out, like brake pads, wiper blades or floor mats, generally gets no coverage. If you use your car for certain commercial purposes, such as a taxi or delivery vehicle, most warranties will not provide for repairs in those cases. DVD, navigation and other infotainment systems receive shorter coverage than the rest of the car.

    If you modify the car, particularly with non-factory parts, you may void the warranty, or at least warranty coverage of related parts. For instance, if you put in a new audio head unit and the factory speakers blow out, you’re on your own. If you install aftermarket wheels that are a different size than the original equipment, any suspension or brake damage will likely be denied coverage. Some accidents, re-titling of the car as “salvage” and ignoring maintenance are all ways to get coverage denied.

    The Fine Print

    Legalese abounds in warranty guides. And there is lots of fine print in a new-car warranty, despite Federal legislation from the 1970s that requires “readily accessible” and “unmistakable” language. For example, Kia’s 2011 warranty runs 118 pages.

    Warranty books also often explain how to remedy the situation when you feel that you have been denied a legitimate claim. In virtually all cases, before you can file suit, you must try mediation and arbitration. One of the primary arbitrators in the U.S, who works with almost all manufacturers, is the Better Business Bureau, whose BBB Auto Line (www.bbb.org/us/auto-line-lemon-law/) has been resolving disputes between consumers and automakers for more than 30 years. If neither mediation nor arbitration work and you do need to file suit, the Magnusson-Moss Warranty Act provides that the manufacturer must pay your legal costs if you prevail, so there is definitely an incentive for them to fix a problem.

    However, if your car is under warranty for a covered problem, in most cases you will have little trouble getting the dealer to submit a warranty claim. After all, the dealer gets paid by the manufacturer to fix the car. There are even cases of manufacturers fixing cars that have just slipped out of warranty for what may be a defective part. You won’t find this goodwill move on any documentation in your glove box and it is not something the manufacturer is compelled to do, but it happens more than you might think.

    What to Look for in a Warranty

    The longer the bumper-to-bumper or basic warranty, the more protection you have against defects in the car. And the powertrain warranty can also help keep your piece of mind against the most expensive repairs down the line. However, not all warranties are transferable to the next owner. Take Hyundai and Mitsubishi’s 10/100 powertrain warranties. They only cover the first buyer. Subsequent buyers are only covered up to 5 years and 60,000 miles. But Suzuki’s 7/100 warranty is fully transferable to the next owner. Come resale time, the remaining factory warranty could be a factor in the price you get — provided you let a prospective buyer know about it.

    Given the quality and preparation for steel that goes into today’s cars, rust is practically a non-issue. But some European cars are noted for having long corrosion warranties, including quite a few brands with 12 years and unlimited mileage.

    Beyond the basic warranties, some manufacturers include scheduled service. While not technically a warranty, an included scheduled maintenance program can significantly reduce the out-of-pocket expense and unpredictability of owning a car, particularly a luxury model. But, much like a warranty, you pay for this service in the cost of the car, with estimates ranging from under $1,000 to over $3,000, depending on the model. Some brands may include the first service or adjustments during the first year while others will cover everything, from oil changes to any consumable on the car, including brakes pads and wiper blades for the duration of the warranty period. The current champ in that regard is Jaguar, who for 2011 include not only a 5/50 warranty, but also 5/50 of service in the price.

    Roadside assistance has become another common add on to new car warranties. Again, the coverage varies. For some automakers, like Chrysler and Nissan, roadside assistance will only cover towing services for a car with a warrantable condition. Other brands include lock out service, spare tire mounting and even a couple of gallons of gas when you run out.

    There are lots of choices to make when buying a new car and lots of factors to consider. While the warranty details may not make the top of that list, it’s certainly worth considering when it can make the difference between two similar models.

    Getting a little peace of mind when you buy a preowned car isn’t always easy. We help you navigate certified preowned warranties, aftermarket alternatives, and not voiding your coverage.

    Figuring out whether to buy a warranty on a used car, or how to do it, can be a tangled mess. But we’re here to help. For some advice on buying used, what warranties are best on the CPO front, and what to watch out for in extended warranties if you don’t buy a CPO vehicle, read on. As you might imagine, it all starts with “read the fine print.”

    Go CPO

    Certified preowned-car warranties provide peace of mind because factory warranties are backing the product, but Anderson says there’s another crucial factor: manufacturer vetting. CPO cars have to be in good to great shape to be insurable. “The only way [car companies] can offer CPO is because they’re making money on the aggregate of the warranties. If they weren’t, the business model wouldn’t make any sense.”

    Like any insurer, carmakers want to insure mostly healthy patients. But unlike health insurance providers, car companies can inspect every patient top to bottom to make sure it’s healthy. They’ll do small repairs to prep a CPO for sale, but any vehicle that needs major work, such as a new transmission, will never make it into the certified preowned pool.

    The upshot: A CPO car is already a good machine or the carmaker would never sell it as such. That puts the dealer in a position where he doesn’t feel like he has to hide anything from you.

    Shopping for CPOs

    But just as new-car warranties differ, not all CPO warranties are created equal. When you’re shopping for one, Anderson says, look first at the deductibles. Audi charges $85, BMW $50, and Land Rover $100, none of which may surprise you (though neither Mercedes or Lexus charges a deductible). But it is a shocker that Chrysler charges $150 and Ford $100.

    Also, check whether the CPO warranty is transferable if the car is sold prior to its expiration, which could apply to you if you’re the buyer or the seller. Audi, Infiniti/Nissan, and Lexus all say no, but Kia will let you transfer a warranty, though it charges $40.

    There’s a ton of fine print that comes with CPO warranties. Read it the details should be on the manufacturers’ websites. The information within covers a lot of ground. Can you finance a CPO car? Can you lease a CPO car? Is roadside assistance included? Look for deal-breakers. There’s no such thing as perfection; it just depends on where you’re willing to bend and where you’re not.

    The biggest question, however, is the obvious one: how much coverage you’re going to get and for how long. Lexus offers three-years/100,000 miles, which is one of the best CPO warranties around. It compares favorably witih other programs that offer anywhere from three months comprehensive/12 months powertrain to 24 months comprehensive coverage.

    To Extend the CPO Warranty or Not?

    Before you buy a certified preowned car, you should investigate not only the warranty details, but also whether you can buy an extended warranty.

    This is especially true for a luxury car, and even more so if the CPO contract covers only a year or two. Luxury cars are typically expensive to maintain and the extra warranty protection is nearly always a wise play. However, Anderson says, extended warranties are becoming an increasingly smart move even for other vehicles. “Think of Ford’s Sync or any other sophisticated electronic system,” he says. When it goes south, it requires a great deal of troubleshooting. “Often the parts are cheap, but it takes them a long time to figure out why something isn’t working, and at $85 or $120 an hour, that labor adds up quickly.”

    But (you knew there was a but, right?), not all extended warranties are necessarily worth it. Audi doesn’t even offer one, nor does Porsche or Mini, and even if you can get one you still need to look at the limitations. For instance, you might find an extended warranty that covers up to five years, but ends at 74,000 miles. If you’re buying a car with 60,000 miles on it already, that extended warranty isn’t much good.

    Finally, a little secret of the extended warranty game is that they cost the dealer a set amount. How much isn’t public knowledge and carmakers won’t share that information, but dealers are free to use it as a bargaining chip. They can throw it in with the purchase price of a CPO car or non-CPO car; they can charge more than it costs them. The point is that it’s negotiable, so you should feel free to ask for the time to study what the warranty covers and what it doesn’t, and haggle over the price.

    After dedicating an afternoon (or more) to test driving, negotiating, and completing a pile of paperwork for your shiny new car, don’t be surprised if a bubble-bursting finance manager at the dealer gives a compelling pitch for an extended warranty. It is for your peace of mind, right? Well, not really.

    The last-ditch effort to sell you a warranty, or various other unnecessary services, is the dealership’s final assault on your checkbook before you tuck it securely away and drive off. Sure, the pitch is convincing: Should an expensive repair be necessary after the factory warranty ends, you’d be protected. No one wants a big, financial surprise, nor wishes to be stranded roadside.     But breathe deep and think this through. A survey conducted by the Consumer Reports National Research Center in late 2013 found that 55 percent of owners who purchased an extended warranty hadn’t used it for repairs during the lifetime of the policy. And, on average, those who did use it spent hundreds more for the coverage than they saved in repair costs.

    Among survey participants who used their policy, the median out-of-pocket savings on repairs covered by extended warranties for all brands was $837. Based on a $1,214 average initial cost, that works out to a net loss of more than $375. Factoring those who didn’t use their policy, the median savings was zero. And that may have something to do with why satisfaction with auto­mobile extended warranties is among the lower rated of all products and services surveyed by Consumer Reports, and why only about a quarter of respondents said they would definitely get it again.

    Before we get into more detail it’s important to understand the different parts of an auto warranty. It’s also good to know the difference between a new car warranty and an extended auto warranty. A typical new car warranty has two parts: the “bumper to bumper” warranty, which covers everything except the “wear” items such as brakes and tires; and the powertrain warranty that covers all the parts that make the car move, such as the engine and transmission.

    An extended auto warranty can be purchased to prolong the coverage of the bumper-to-bumper warranty. Most people are familiar with the extended warranty that is sold at dealerships. This is sometimes called a “factory warranty” because factory-trained technicians perform the required work on the car. There are also “third-party” warranties which can save consumers money but are generally less convenient to use. Many third-party warranties require out-of-pocket payment for repairs before reimbursement. Weigh all these factors carefully before you make your choice.

    Beware of Auto Warranty Scams

    The FCC Consumer Center noticed an increase in complaints and inquiries from consumers who received calls about renewing their automobile warranties. During the calls, which are usually automated or pre-recorded, the consumer is told that the warranty on his or her automobile is about to expire and is instructed to press a number to renew it. The callers often pose as representatives of a car dealer or manufacturer, and may or may not have specific information about the consumer’s particular car and warranty.

    Many of these calls may violate FCC Do-Not-Call rules. Many may actually be fraudulent—if you press a certain number or stay on the line, you may be asked to provide several types of personal information, including your credit card number, which can be used to defraud unwary consumers. The Federal Trade Commission (FTC) filed suit in federal court against companies suspected of making these calls. The FCC also investigates potential violations of FCC rules, and some states and telephone companies have sued companies that make these types of calls.

    The FCC’s Rules

    If you have placed your residential wired telephone number or your personal wireless phone number on the National Do-Not-Call list and you receive one of these calls, from anyone other than a business that sold you the car or repaired it, that call may violate the FCC’s Do-Not-Call rules. In addition, if you receive one of these calls on a wireless device, and the call is pre-recorded or placed using an autodialer, it may also violate the FCC’s rules unless you have given your prior consent to be called. Also, anyone making a telephone solicitation call to your home number must provide his or her name, the name of the person or entity on whose behalf the call is being made, and a telephone number or address at which that person or entity can be contacted. If the call is a pre-recorded message, it must include a contact telephone number. The call violates FCC rules, without these disclosures

    If you have caller ID, a telemarketer is required to transmit or display its phone number and, if available, its name or the name and phone number of the company for which it is selling products. The display must include a phone number that you can call during regular business hours to ask that the company no longer call you. This rule applies even if you have a previously established business relationship with the company, and even if you have not registered your home phone number(s) on the national Do-Not-Call list.

    What to Do If You receive an Auto Warranty Call

    First, do not provide any personal information, such as social security numbers, credit card information, driver’s license numbers, or bank account information to the caller. Telephone scammers are good at what they do and may imply that they work for a company you trust. Second, if you have certain information about the call or caller, you can file a complaint with the FCC. In some cases, the FCC can issue warning citations and impose fines against companies violating or suspected of violating the do-not-call rules, but the FCC does not award individual damages.
