The policy has cash value, with the insured being able to borrow against it, and a portion of each premium payment is invested. Assuming that there are no issues with the policy and no further investigation is required, benefits will be disbursed among all beneficiaries listed on the policy after the claim has been processed.

Liability coverage on a Massachusetts policy only provides coverage for injuries that you cause to another driver or their passengers within the state. Massachusetts has laws that protect consumers when buying or leasing a new car. and buying a used car that does not meet expectations. These Lemon Laws require dealers to provide consumers with a written warranty against defects that impair a used vehicle’s use or safety, and require private parties to disclose any known use or safety defects.

Registration and Insurance

Separately, residents can apply for new plates or transfer an existing registration to a vehicle gifted by or purchased from a friend or family member. To do so, they will need:

Sales Tax

Sales tax equal to 6.25 percent of the vehicle’s purchase price is collected when a vehicle is bought from a dealer. In private sales, 6.25 percent of the purchase price or 6.25 percent of the National Automobile Dealers Association (NADA) trade-in value — whichever is higher — is collected on the purchase of any new or used vehicle in Massachusetts. If no clean trade-in value is available, a default value agreed upon by both the RMV and Massachusetts Department of Revenue (DOR) will be used.

If a vehicle is purchased outside of Massachusetts and sales tax is not paid in another state, sales tax must be submitted to Massachusetts by the purchaser. However, if sales tax was paid to the state of purchase, taxes may still be due to Massachusetts depending on the reciprocity relationship between states. A car purchased from a family member — or received as a gift — may be exempt from sales tax.

Vehicle Titles

A title is a document that indicates who has legal ownership of a vehicle. Anyone planning to buy or sell a used car (model year 1981 or newer) must have a title to transfer ownership so the buyer can register the vehicle. Without this, it cannot be registered.

Vehicles older than model year 1980 purchased by the current owner before November 26, 1990 can be registered without a title, as long as the bill of sale and a copy of the last registration for the vehicle are available.

Seven-Day Grace Period

In accordance with Massachusetts General Laws Chapter 90 Section 2 — also known as the Massachusetts Seven-Day Registration Transfer Law — if you transfer ownership or lose possession of a motor vehicle, you have a seven-day grace period to transfer registration to a new vehicle.

This period begins on the date you transfer ownership or lose possession of the first vehicle and ends at 5 p.m. seven calendar days afterward. For example, if you transfer ownership of your car at noon on July 1, the grace period would end at 5 p.m. July 8.

To qualify for this grace period the following conditions must be met:

  • You have an active registration and are at least 18 years of age
  • The newly acquired vehicle or trailer must be of the same type and have the same number of wheels as the previous vehicle or trailer
  • You must carry the transfer documents, which show the registration number to be transferred, in your vehicle
  • You have lost possession of or disposed of your previous vehicle
  • The registration plates must be attached to the newly acquired vehicle

Westport Car Dealership Messes With Pizza Delivery Guy, Feels Internet’s Wrath

A video of car dealership employees in Westport getting into a heated argument with a local pizza delivery man over $7 has led to Internet anger and a personal apology.

The video, posted on Liveleak, begins with a delivery man returning $7 in cash to the dealership that he had thought was a tip. By the end of the video, one dealership worker threatens to put my foot in your ass and another says he will call the delivery man s manager and get him fired.

The delivery man in the video is an employee at Palace Pizza named Jarrid Tansey, according to two employees there. Lianette Hernandez, a cook and cashier, and Adam Willoughby, a manager, confirmed the video came from an interaction at the nearby dealership F R Auto Sales on Saturday.

The total bill for the pizza and drinks was just over $42, Hernandez said, and dealership workers gave Tansey $50 in two twenties and two fives. In the video, Tansey says he confirmed that they wanted to give the whole $50, and then left with what he assumed was a $7-and-change tip.

However, the dealership then called the pizza place back and forced him to return the $7-and-change, and he was left without a tip, leading to the heated conversation on video.

It just doesn t make sense why you d hand me a bill that you were just gonna have me drive back here to give you back anyway, Tansey says in the video. I m not mad, I just had to waste my resources coming back here.

But the office-workers are adamant about their position in the video.

So listen: The manager apologized once for you. Do you want him to apologize again for you? the worker in blue says.

Out the door before I put my foot in your ass, a female office-worker in green says.

Get the f—ing owner and the manager on the phone, I want that mother-f—er done, another man in the office says after Tansey leaves. I want him fired.

The video was originally posted on YouTube, but it has since been made private. However, a Google index of the video shows the title as originally being irate pizza driver. The angle of the video suggests it comes from a stationary security camera inside the dealership s office.

Willoughby, who was working that night, said he got a call from F R Auto Sales saying that Tansey had verbally berated them. He said they took the call seriously at first and asked Tansey about the interaction. After Tansey explained what had happened, managers decided not to discipline the driver.

This isn t the first time we have had problems with F R Auto, Willoughby said.

All the time, there s always a problem, always an issue, Hernandez said. We ve been going back and forth with them for a long time.

Palace Pizza has been getting supportive calls all day from across the country, and several people have pledged to raise or donate money for Tansey.

In addition, the owner of the dealership and his son came by to apologize to Palace Pizza in person on Wednesday.

I was the manager on that night, and today they came and spoke to me, profusely apologized, Willoughby said. We both want to make things right between us. We don t want any bad blood.

Commenters who claim to have seen the YouTube video before it was made private identify the dealership as F R Auto Sales in Westport. Review pages of that dealership on Yelp and Google were being flooded with negative ratings on Wednesday. In addition, the dealership s website struggled to load.

Calls to the dealership through their main phone line did not go through. Messages left through the site s Google Connect link, Facebook account, listed email, and on Twitter were not immediately returned.

History

The earliest settlers of the Elizabeth Islands were the Wampanoag Native Americans. The tribe did not settle permanently on the Elizabeth Islands, but used them in summer for hunting. fishing. and gardening. Occasionally, arrowheads or stone tools are unsurfaced on the islands. The islands’ names come from the Wampanoag language .

The Elizabeth Islands, including Cuttyhunk, were discovered by Europeans in 1602 by Bartholomew Gosnold. He and his crew attempted to establish a trading post on Cuttyhunk so that they could trade with the natives, the first attempt by Europeans to do so. The trading post was abandoned after only a few weeks, and Gosnold decided to return home. Upon his return to England. the British Crown claimed jurisdiction of the island chain.

Gosnold was first settled in 1641, the year of purchase of the islands by Thomas Mayhew, Sr. The islands were claimed by the Wampanoag until 1658, when the Wampanoag sachem transferred the deed of ownership to Mayhew. Constituting Dukes County. New York since 1683, the Elizabeth Islands, Martha’s Vineyard. and Nantucket. were transferred to the newly created Province of Massachusetts Bay in 1691. Gosnold was officially incorporated in 1864, having formerly belonged to the town of Chilmark. [ 1 ]

Geography

According to the United States Census Bureau. the town has a total area of 140.2 square miles (363 km 2 ), of which, 13.3 square miles (34 km 2 ) of it (9.52%) is land and 126.8 square miles (328 km 2 ) of it (90.48%) is water. Gosnold ranks 272nd out of the 351 communities in the Commonwealth in terms of land area; however, it has the longest distance between points within municipal limits of any town in the Commonwealth. It consists of the Elizabeth Islands, including Nonamesset Island. Uncatena Island. Naushon Island. Pasque Island. Nashawena Island. Penikese Island. Cuttyhunk Island and several smaller islands. The string of islands extend roughly southwest of the southwestern tip of Falmouth. with the closest island, Nonamesset, being less than a third of a mile away at its closest point. More than half the population lives on Cuttyhunk, with the majority of the rest living on Naushon.

Demographics

As of the census [ 10 ] of 2000, there were 86 people, 46 households, and 21 families residing in the town. The population density was 6.4 people per square mile (2.5/km²). There were 215 housing units at an average density of 16.1 per square mile (6.2/km²). The racial makeup of the town was 95.35% White. with no African Americans. Native Americans. Asians. or Pacific Islanders, and 4.65% from two or more races. None of the population is Hispanic or Latino of any race.

There were 46 households out of which 17.4% had children under the age of 18 living with them, 34.8% were married couples living together, 8.7% had a female householder with no husband present, and 54.3% were non-families. 45.7% of all households were made up of individuals and 6.5% had someone living alone who was 65 years of age or older. The average household size was 1.87 and the average family size was 2.71.

In the town the population was spread out with 17.4% under the age of 18, 5.8% from 18 to 24, 32.6% from 25 to 44, 31.4% from 45 to 64, and 12.8% who were 65 years of age or older. The median age was 42 years. For every 100 females there were 138.9 males. For every 100 females age 18 and over, there were 144.8 males.

The median income for a household in the town was $22,344, and the median income for a family was $27,500. Males had a median income of $21,875 versus $30,625 for females. The per capita income for the town was $15,265. There were 25.0% of families and 23.5% of the population living below the poverty line. including 40.0% of under eighteens and 22.2% of those over 64.

Despite its being the least populous community in the Commonwealth, Gosnold is not the least densely populated, with that title belonging to Mount Washington. at the southwestern corner of western Massachusetts.

Gosnold was first in a 2008 ranking of all Massachusetts communities in terms of total value of real estate per resident. [ 11 ]

Government

On the state level, Gosnold is represented in the Massachusetts House of Representatives as a part of the Barnstable, Dukes and Nantucket district, which includes all of Martha’s Vineyard and Nantucket, as well as a portion of Falmouth. The town is represented in the Massachusetts Senate as a portion of the Cape and Islands district, which includes all of Martha’s Vineyard, Nantucket and most of Barnstable County (with the exception of Bourne. Sandwich. Falmouth and a portion of Barnstable ). [ 12 ] All of Dukes County is patrolled by the Fifth (Oak Bluffs) Barracks of Troop D of the Massachusetts State Police. [ 13 ]

Gosnold is governed on the local level by the open town meeting form of government, and is led by a board of selectmen. Due to its geographic isolation and small population, the town has a waiver from the Commonwealth from anti-nepotism laws. [1]

Education

The town currently has four students (as of the 2009-10 school year) attending school in Cuttyhunk, with others attending schools on the mainland. Penikese Island is also home to The Penikese School, a private school for troubled boys.

What is the difference between a OUI, DUI, DWI, OWI, DWAI, OUIL, etc.

These terms are all acronyms that refer to the offense commonly known as drunk driving. Different states have different names for the crime. Massachusetts law prohibits operat[ing] a motor vehicle. while under the influence s o many people use the term OUI. The statute title refers to driving while under influence which could be referenced as DWUI, DWI or DUI. MGL Chapter 90, Section 24. This site uses the terms OUI, DUI, and DWI interchangeably.

I just got arrested for a Commonwealth of Massachusetts OUI offense. What happens now?

ISSUE ONE: The Massachusetts Administrative License Suspension Proceeding: Your Massachusetts drivers license (or your right to drive in Massachusetts if you re not a Massachusetts licensed driver) was most likely suspended for anywhere from 30 days to five years for failing or refusing a chemical test depending on your OUI history. [Failing a breath test is registering .08 percent or greater BAC or registering .02 percent or greater BAC if you re under 21 years of age.]

MASSACHUSETTS ADMINISTRATIVE LICENSE SUSPENSIONS FOR PERSONS 21 YEARS AND OLDER

No Prior OUI s

Read your paperwork carefully. If you would like to challenge the suspension for failing or refusing a chemical test, you must make you appeal within 15 days of your arrest. Requesting an appeal gives you a chance to overturn the administrative suspension, but most appeals are not successful. Contact a Massachusetts lawyer for more information about your appeal rights.

ISSUE TWO: The Massachusetts OUI Criminal Case: Separate from the administrative license suspension is the criminal charge for operating under the influence or OUI. In Massachusetts, it is unlawful for any person to operate a motor vehicle while the person:

has a BAC of .08 percent or greater of alcohol in his or her blood; or

is under the influence of intoxicating liquor, or marijuana, or narcotic drugs, or depressants, or stimulants, or the vapors of glue.

Important: The administrative license suspension and the criminal OUI case are separate proceedings.

Will my Massachusetts driver license be revoked / suspended?

RELATED TO ISSUE ONE ABOVE: Your Massachusetts driver license (or your right to drive in Massachusetts if you do not have a valid Massachusetts license) may be suspended for failing or for refusing a chemical (breath) test. Again, you may challenge this suspension by requesting an appeal / hearing within 15 days of the date of your arrest. Massachusetts no longer issues temporary permits for these suspensions.

RELATED TO ISSUE TWO ABOVE: If you are convicted of the OUI charge. you will also lose your license (or your right to drive in Massachusetts if you don t have a valid Massachusetts license). This suspension is distinct from the administrative license suspension. Talk to your Massachusetts OUI lawyer for possible suspension lengths for your situation.

Also keep in mind that your license can be suspended for a variety of reasons unrelated to an OUI arrest e.g. a drug conviction, failure to pay child support, etc.

I have a Massachusetts commercial driver license (CDL). How long will my CDL be suspended for an OUI conviction?

For a first OUI conviction in Massachusetts your CDL will be suspended for one year (regardless of whether you re driving a commercial vehicle). For a second DWI your CDL will be revoked for the rest of your life.

What happens if I get caught operating on a suspended license?

Driving a motor vehicle when your license is suspended for an OUI conviction must be avoided as it is a new criminal offense. Penalties include fines and substantial jail time–typically 60 days. If you re on probation for an OUI and you get caught operating under a suspension you will also violate your probation and face penalties for the probation violation as well.

I really need to drive. Will I be able to get a restricted / occupational / conditional / probationary / hardship permit?

A hardship permit may be available to you but only after you ve been found guilty or had a continuance without a finding (more on that below). Put another way, a hardship license is not available for suspensions related to failing or refusing a breath or blood test while the criminal case against you is pending.

This is one reason why persons charged with a first OUI offense may decide to resolve their case without a trial. It allows you to get back on the road quicker (especially if you refused the breath test).

You may be able to get a hardship permit following a second OUI conviction; however, there will be a substantial waiting period before you become eligible. Additionally, you will have to install an ignition interlock device in your vehicle.

A car purchased from a family member — or received as a gift — may be exempt from sales tax.

Vehicles older than model year 1980 purchased by the current owner before November 26, 1990 can be registered without a title, as long as the bill of sale and a copy of the last registration for the vehicle are available.

Seven-Day Grace Period

In accordance with Massachusetts General Laws Chapter 90 Section 2 — also known as the Massachusetts Seven-Day Registration Transfer Law — if you transfer ownership or lose possession of a motor vehicle, you have a seven-day grace period to transfer registration to a new vehicle.

This period begins on the date you transfer ownership or lose possession of the first vehicle and ends at 5 p.m. seven calendar days afterward. For example, if you transfer ownership of your car at noon on July 1, the grace period would end at 5 p.m. July 8.

To qualify for this grace period the following conditions must be met:

Massachusetts has laws that protect consumers when buying or leasing a new car. and buying a used car that does not meet expectations. Registration and Insurance

Sales Tax

Sales tax equal to 6.25 percent of the vehicle’s purchase price is collected when a vehicle is bought from a dealer. In private sales, 6.25 percent of the purchase price or 6.25 percent of the National Automobile Dealers Association (NADA) trade-in value — whichever is higher — is collected on the purchase of any new or used vehicle in Massachusetts. If no clean trade-in value is available, a default value agreed upon by both the RMV and Massachusetts Department of Revenue (DOR) will be used.

If a vehicle is purchased outside of Massachusetts and sales tax is not paid in another state, sales tax must be submitted to Massachusetts by the purchaser. However, if sales tax was paid to the state of purchase, taxes may still be due to Massachusetts depending on the reciprocity relationship between states. A car purchased from a family member — or received as a gift — may be exempt from sales tax.

Vehicle Titles

A title is a document that indicates who has legal ownership of a vehicle. Anyone planning to buy or sell a used car (model year 1981 or newer) must have a title to transfer ownership so the buyer can register the vehicle. Without this, it cannot be registered.

Vehicles older than model year 1980 purchased by the current owner before November 26, 1990 can be registered without a title, as long as the bill of sale and a copy of the last registration for the vehicle are available.

Seven-Day Grace Period

In accordance with Massachusetts General Laws Chapter 90 Section 2 — also known as the Massachusetts Seven-Day Registration Transfer Law — if you transfer ownership or lose possession of a motor vehicle, you have a seven-day grace period to transfer registration to a new vehicle.

This period begins on the date you transfer ownership or lose possession of the first vehicle and ends at 5 p.m. seven calendar days afterward. For example, if you transfer ownership of your car at noon on July 1, the grace period would end at 5 p.m. July 8.

To qualify for this grace period the following conditions must be met:

  • You have an active registration and are at least 18 years of age
  • The newly acquired vehicle or trailer must be of the same type and have the same number of wheels as the previous vehicle or trailer
  • You must carry the transfer documents, which show the registration number to be transferred, in your vehicle
  • You have lost possession of or disposed of your previous vehicle
  • The registration plates must be attached to the newly acquired vehicle

In Massachusetts. a bill of sale is needed whenever you buy or sell a motor vehicle. Before the buyer can register the car title in their name, the Massachusetts Registry of Motor Vehicles will require that a motor bill of sale and the car’s certificate of title be presented as proof of the sale or transfer. Fortunately, you can obtain a blank bill of sale for free.

Obtaining a Free Bill of Sale Form

The Internet provides hundreds of resources for bill of sale templates that can be used to transact the sale of a vehicle in Massachusetts. You can use a search engine to quickly locate sites where you can download a form that will meet the requirements of the Massachusetts RMV. To find these sites, enter search terms like ‘car bill of sale’ or ‘Massachusetts bill of sale form.’ The search engine will display hundreds of links where you can download the form for free.

Massachusetts does not require that a vehicle bill of sale form be notarized. However, if you want to further insulate yourself from potential liability, or if the buyer is making payments to you for the vehicle, you may want to have the bill of sale witnessed by a Notary Public to give the document more credibility, should you ever need to present a bill of sale contract in court.

What Needs to Be on a Massachusetts Bill of Sale Form?

Unlike some other states, Massachusetts does not provide a standardized bill of sale template that can be used for buying or selling a vehicle. Almost any vehicle bill of sale template that you download on the Internet should suffice. Generally speaking, a vehicle bill of sale form is acceptable in Massachusetts if it contains the following information:

  • Name and address of the buyer
  • Name and address of the seller
  • Date of the transaction
  • The odometer reading of the vehicle
  • The sales price of the vehicle
  • A description of the vehicle being sold
  • The VIN number of the vehicle
  • Signature of both parties

Although a bill of sale with the above required information is acceptable in Massachusetts, you may want to consider adding additional information or contract language. For example, if you are selling the vehicle without a warranty, you should ensure that the bill of sale states that the vehicle is being sold ‘As Is’ and without a warranty. Additionally, if the buyer is making payments to you on the car, make sure that the bill of sale states that the vehicle has not been fully paid for as of the date of the form signing.

Filling in the Blanks on a Bill of Sale

Once you download a template for a bill of sale form, you’ll find that filling in the blanks is rather easy. In fact, most of the information you’ll need to fill in is completely self-explanatory. When searching for template forms, try to find a PDF file that you can fill in using your computer. If you do download a template that needs to be filled in by hand, make sure to fill out the form legibly and put forth your best handwriting.
