Bill of Sale Basics

When you’re transferring goods to a buyer, a bill of sale form is the easiest way to make it legal. But just because a bill of sale is a fairly straightforward legal document doesn’t mean you shouldn’t know a few things before you start.

When you shouldn’t use a Bill of Sale

For real estate: If you’re planning on transferring real estate property, you can’t use a bill of sale form. Real estate transactions are simply much more complicated and require different forms, such as a quit claim deed, or forms available only from your state or local government. Consult with a real estate attorney or real estate agent if you’re looking to transfer this kind of property.

For services: A bill of sale should be used when transferring goods, not when performing services. If services are involved (such as woodworking, babysitting, business consulting, etc.), it’s a better idea to use a general contract for services.

For small sales: This is a matter of personal preference, but most people do not feel it necessary to use a bill of sale when transferring cheaper property. If you’re selling a used guitar, a bill of sale makes a lot of sense. If you’re selling a couple old fishing lures, it might be more trouble than it’s worth.

Specific types of Bills of Sale

For certain items or classes of property, you’ll need to use a specific bill of sale. That’s because those bills of sale will contain information required to make the sale legal. Here are a few of those types of bills of sale, all of which we provide.

Car bill of sale Used car sales between two parties are incredibly common, but you can’t use any bill of sale to transfer the ownership of a car. That’s because a car bill of sale has specific information you need to provide to actually purchase (or sell) an automobile. For example, to legally sell a car, you’ll need to let the buyer know the VIN number, the make and model of the car, the odometer reader, and whether or not that car is under any sort of warranty. Failure to provide that information can actually void the sale of the car.

A motorcycle bill of sale will contain nearly all that information as well. Omitting any of those details can likewise void the sale.

Boat bill of sale Like a car bill of sale, a boat bill of sale contains information about the make, model, year, price, and valid warranty of the watercraft in question. But unlike a car, a boat has what’s called a HIN (this stands for hull identification number.) Like a VIN, it’s unique to each boat and is used by government agencies in keeping track of the ownership chain.

Benefits of a Bill of Sale Form

A bill of sale helps the transfer of property go smoothly for both buyers and sellers.

Taxes: as a seller, you may need to report the sale amount as part of your tax documents or for business accounting purposes.

As-Is: indicating on a bill of sale that you have sold property “as is” protects you as a seller if the buyer encounters problems with the item after purchase. For example, if a person buys an automobile from you and it breaks down after he or she drives away, you are not responsible for the repairs or damages.

Transfer of Ownership: a bill of sale also documents when the item was transferred to a new owner, which can be critical in certain cases. For example, if someone buys a gun from you and the gun is then used to commit a crime, a signed bill of sale form may be used as supportive evidence that you were not the owner of the firearm at the time of the crime.

Proof of Ownership: as a buyer, a bill of sale provides proof of ownership, allowing others to verify your rights to property. Whether registering a motorcycle at the DMV or totaling the value of your assets for a bank loan, the document serves as required proof of ownership.

Date of Ownership: other benefits include documentation of the date that you became owner of an item, preventing disputes about when the property was transferred. The value of the property as agreed on by buyers and sellers is also included on a bill of sale form, limiting conflict over how much was paid or received and/or when payment(s) were made.

If you do a search for “used car classifieds ” on any search engine, you’ll get hundreds of sites allowing you to list your car for sale.

Obviously you don’t want to spend hours sifting through all that data and figuring out which sites are worthwhile to list on. Luckily, there’s only a few that are really important.

The two largest are Cars.com and AutoTrader.com.

Cars.com syndicates their listings to over 175 newspapers and partners such as Yahoo Autos. They have about 3 million used cars for sale at any given time.

Their premium listing is $55 and comes with a 90-day money back guarantee along with a free CARFAX report (worth $34.99). They also offer a $15 basic ad listing which will show your ad for 21 days, but with no money back guarantee or CARFAX report.

AutoTrader.com offers a similar package. A $60 listing gets you a money-back guarantee while their less-expensive $20 listing stays active for 3 weeks – but with no money-back guarantee.

Cars.com and AutoTrader offer a huge database of used car listings, but most are actually dealer listings.

The largest for-sale-by-owner site is Craigslist . The listings here can be very un-organized, but it’s definitely worth including your vehicle – and the best part: it’s Free!

You’ll also want to include your vehicle in eBay Motors Local Classifieds section. They will display your listing to anyone that searches for your car within a 200 mile radius of your location. The service is free and even comes with a limited CARFAX report worth $19.95.

By listing your used vehicle on these four sites, you should have all your bases covered.

    The timing isn’t the best for a top-end sedan.

    The Taurus was once America’s favorite family car, the top-selling model of the 1990s that popularized the aerodynamic look. Then a radical redesign failed to catch on, consigning it to an ignominious dotage as a rental car fleet mainstay. Now, Ford Motor is betting that this faded star can make a comeback, this time in China as a top-of-the-line sedan aimed at businessmen with a weakness for legroom and power-reclining massage seats.

    That won’t be easy. With a starting price of 248,800 yuan ($39,000) that tops out at 348,800 yuan for the most expensive trim line, the Taurus is crossing into luxury sedan territory dominated by BMW’s 3 Series, Audi’s A4L, and Mercedes-Benz’s C-Class. It’s also almost double the price of Great Wall Motor’s H6, the best-selling SUV in China. The country’s buyers have been ditching traditional sedans for roomier utility vehicles and minivans, sometimes called MPVs (for multipurpose vehicles).

    The Chinese market has slowed sharply since April, when Ford introduced the car there. Since then, a stock market rout and a weakening economy have sapped car demand, which was also hit by stricter vehicle registration curbs imposed by cities trying to stem worsening traffic and air pollution.

    Things got so bad that the government in October cut a 10 percent vehicle purchase tax by half to encourage sales—but the incentive won’t apply to the Taurus because its 2.7-liter engine is too large to qualify. “The segment where it will play doesn’t grow anymore,” says Jochen Siebert, Shanghai-based managing director at JSC Automotive Consulting. “But Ford should be able to win some market share, provided they get the price right.”

    To help position the Taurus as a high-end business sedan worthy of its luxury-level sticker price, Ford has signed up actor Chen Daoming to endorse the model. He’s well-known for playing emperors in Chinese period dramas, including a popular 2001 epic on the reign of the 17th century Qing dynasty monarch Kangxi.

    Whether that will help lend the Taurus an imperial touch remains to be seen. Yang Song, a sales executive who owns a Jaguar XJ sedan and Jeep Grand Cherokee SUV, says he may consider buying a Taurus because it’s “good value for money,” though he thinks it lacks aspects found in BMWs, which he says have “firmer doors.” (Local drivers like a satisfying thud.) “It looks good for people using it in business,” says Yang, 50, while checking out the Taurus at the Guangzhou auto show in November. “I like that it’s spacious and exudes gravitas.”

    The original 1986 Taurus was a hit with American buyers, its design standing out from the boxy shapes that were standard for family cars. By 1992 it had displaced Honda Motor’s Accord as the top-selling car in the U.S. reaching a sales peak of 409,751 vehicles that year. A radical restyling in 1995 and a price increase caused sales to slump, and Taurus ceded the No. 1 title in 1997. Its fading consumer appeal left it relegated to purchases by rental companies before being shelved in 2006. Although it was resurrected in the U.S. in 2009, the model has never again approached the popularity of its ’90s heyday.

    Besides being on the wrong side of China’s SUV mania, analysts say, the Taurus is unlikely to become one of the mainland’s biggest models because of its price. Ford’s car costs more than twice the average sticker price for the 10 top-selling cars in the country, about 100,000 yuan, according to data from the China Association of Automobile Manufacturers. The best-selling model, Volkswagen’s Lavida, starts at 109,900 yuan. Ford’s Focus compact, starting at 99,800 yuan, was seventh in sedan sales in China in the first 10 months of the year, with 207,200 units, down 37 percent from a year earlier.

    While Ford’s SUV models are doing well in China, the sedan sales slump there has dragged down Ford’s retail deliveries by 0.4 percent this year through October, after expanding 19 percent for all of last year. The automaker recorded four consecutive monthly declines from June to September before snapping the streak in October after the government halved the 10 percent purchase levy. Still, Ford is betting that the car, made by its joint venture with Chongqing Changan Automobile, can draw buyers, in part because of creature comforts such as more legroom and an electric massage function for back seats—where affluent, chauffeur-driven Chinese typically ride. “The Ford Taurus will give the business elite a prestigious user experience,” Chen Xu, deputy general manager of Changan Ford Sales, said in a release marking the start of the model’s sales in November. “We believe the Ford Taurus will have an extremely good market performance.”

    Even if the timing isn’t the best to launch a top-end sedan, Ford needs to offer a vehicle like the Taurus if it wants to be a serious competitor in China, says Yale Zhang, a managing director at researcher Autoforesight Shanghai. “Ford needs to fill in every segment to compete in,” he says. “They didn’t have something in the big sedan segment until this.”

    The bottom line: Ford is introducing the Taurus in China at a sticker price as high as $54,500, just as buyers are eschewing sedans in favor of SUVs.

    There s, believe it or not, a certain science to selling used cars that deals with algorithms and buying habits and types of analytical tools. When all is said and done, though, it comes down to this: when is the best time to sell and buy a used car? Obviously the answer is going to be different depending on which side of the equation you are on.

    Mojo Motors has done the scientific research to determine the best months and worst months for buying a used car.

    (Basically, we re going to concentrate on buying a used car for purposes of this article.) Michael Milstein, the business intelligence manager at Mojo Motors, did the basic research and came up with some interesting discoveries.

    But first a little bit of information about Mojo Motors. It is a used car vehicle sales aggregator website that offers a new way to buy used cars. guaranteed pricing at a discount available only through a free membership. When it comes to vehicle sales, it is much more profitable to sell used cars.

    That explains the proliferation of used car vehicle sales sites. Especially popular are those that aggregate offerings from several used car dealers in a set geographical area like Mojo Motors does.

    Millstein came up with these conclusions at his Mojo Motors blog :

    • Dealers drop the price of a car an average of 1.32 times per month, but some months it happens more, and others less.
    • Between July and October dealers drop the price of their cars most frequently, whereas January through March dealers drop their prices least frequently.

    • As the volume of sales increases in the summer months, dealers seem more willing to drop the prices of their used cars.
    • The average price drop on a used vehicle is actually 5.42%.

    Those tidbits of info prompted us to have a little discussion with Paul Nadjarian, founder of Mojo Motors. Here are his answers to some questions we raised.

    Q. Can this data be used as an effective tool when used car shopping? For example, it s July. You know the average price of a used car is going to drop 5.6 percent. Should you just go to the dealer and offer 5% less off the bat? Tell them you know it s still going to be there a month later. How do you think consumers should use this information?

    A. This information should be used to assess market trends, not individual vehicles. The data shows that a dealer will drop the price of a vehicle around 11% in July (5.6% per drop x avg of 2 drops in July). You can t use that as a negotiation tactic. What you should do instead is be aware that July is a good month to catch a great price on a used car and Mojo Motors can keep you aware of these price drops as they happen if you Follow some cars.

    Q. What are the conclusions based on? How much data did Mojo sift through to come to this conclusion?

    A. These findings are based off the data Mojo Motors aggregated from users Following cars from Jan 1 to Dec 31 2012: 161,385 vehicles and 333,568 price drops were analyzed.

    Q. Why is February such a low month for price drops? It would seem in great parts of the country this would be a tougher time to get consumers through the door.

    A. Typically, February is a fairly strong sales month for used cars because car shoppers start to receive their tax return checks they can use for a down payment. Since dealerships know this trend, the number of price drops may be lower.

    Q. And on the flip side, why the upward trend towards the end of the year? Are dealerships trying to hit year-end numbers?

    A. A couple of factors are at work for end of year price drop trends. Firstly, there is a general slow down in car sales during the end of the summer that motivates dealers to drop prices. Secondly, dealerships are working extra hard to pump their sales numbers to clear out inventory as the year comes to a close.

    In the market for a used car, then? Looks like July is going to be your best bet to get a deal. As always, though, keep in mind this is general advice and may not apply directly to a used car you are buying. I still have to believe used convertibles sell for less in February!

    Bank of Ireland launches Personal Contract Purchase for second hand cars

    Bank of Ireland Finance today (Wednesday, 30 July 2014) announced that, together with its franchise partners, it is launching a new Personal Contract Purchase* (PCP) product for second hand cars from Friday, 1 August 2014, the first Irish Bank to offer this product for the purchase of second hand cars. This is an extension of their current PCP offering on new vehicles and will enhance and support the growth of the PCP product through its franchise dealers.

    The Personal Contract Purchase (PCP) is a customer friendly product that allows consumers to drive a new car without the associated costs of ownership of same. Traditionally only available for the purchase of new cars, the extension of the PCP to second hand cars significantly expands the reach of the product across the market. Qualifying second hand cars will include vehicles up to 18 months old. Bank of Ireland has established itself as the market leader in the motor finance industry, partnering with 14 leading motor franchises in the Irish market.

    Pat Creed, Managing Director, Bank of Ireland Finance, said: Conditions in the motor industry have been very challenging since 2007 when new car sales decreased from 152,830 to 74,300 in 2013. Consumers postponed the purchase of a new car which in turn led to a much older car pool in Ireland. It also means that the cost of purchasing a new car is now much greater with less equity in the older trade in.

    However, Bank of Ireland s range of products including PCP and low rate subsidised offers are helping customers get their new car with affordable repayments and rates from as low as 0% APR.

    With more than twice as many 142 cars registered on the first day of the new registration plate compared with the same day last year, it is evident that a significant number of consumers are returning to the market. The growth in the popularity of PCP and low APR rates has been such that over 71% of all new cars purchased by consumers are now selecting these forms of payments. We are seeing very strong approval rates for PCP and low APR rates, with 90% of applications being approved for finance.

    2014 is proving to be the best year for new car sales since 2008 and looks set to achieve sales of 90,000 vehicles by year end. This strong performance, whilst coming from a low base, tends to be a lead indicator and reflective of the re-emergence of consumer and business confidence. This is the second year of the dual registration plate, which has also helped change the traditional seasonality where vehicle purchases would be frontloaded in the first quarter. This has ensured that there is a more steady flow of business throughout the summer months which historically would not have happened prior to the 132 plate launch last year.

    Another impact of the recession was the shortage of used cars for the industry to sell which has resulted in a significant number of cars being imported to supply the demand. It is estimated that the importation of second hand cars will reach 50,000 by the end of this year. The growing popularity of PCP will now ensure that there is a strong supply of good three year old second hand cars coming back to the market on an ongoing basis.

    Interestingly, we are seeing a slightly younger customer profile on our PCP deals. Industry research supports this as it shows that younger customers prefer the lower monthly payment and are also very used to the tariff type concept where they pay for the use of an item and upgrade as with their mobile phones.

    New business in the commercial motor market has seen strong growth in the first six months compared to the same period last year, again a positive indicator of renewed confidence amongst SMEs. The agri sector is also buoyant with a 6.8% increase in tractor sales year to date.

    The C02 changes implemented by Government in July 2008 have been instrumental in influencing consumer purchasing decisions. The last seven years have also seen a significant change in the shift from petrol to diesel purchases and this is reflected in that 71.7% of vehicles purchased in 2007 were petrol and this compares with 73% of cars purchased in 2014 being diesel. Similarly the level of low emission purchases in C02 Band A has increased from 1.42% in 2007 to 67% in 2014.

    A Personal Contract Purchase is a form of vehicle finance for individual consumers who are looking to pay a fixed, relatively low monthly payment for a set contract period of somewhere between 24 and 36 months with the right to drive the vehicle while ownership is retained by the funding company.
