    Self storage units and Mayor Bill de Blasio

    The de Blasio administration is finally moving forward with a proposal it announced 18 months ago to seriously curtail the city’s emerging self-storage industry as part of City Hall’s plan to preserve middle-class jobs by regulating development in certain manufacturing zones.

    City Hall this week introduced a land use application that would require new self-storage facilities to acquire special permits in certain parts of manufacturing districts in the outer boroughs, a move largely seen as tantamount to a ban on the business, which is acutely undersupplied in the five boroughs.

    Mayor Bill de Blasio first brought the subject up in November 2015, when he laid out a 10-point plan to preserve manufacturing jobs in the city. (Another part of that proposal, a requirement for special permits for hotels that has the backing of the powerful hotel trades union. has not yet been introduced.)

    As City Hall fine-tuned its proposal in March, planners considered alternatives such as allowing self-storage as parts of mixed-use developments with manufacturing uses. The alternative is not included in the city’s current application, but self-storage supporter are planning on pushing for its inclusion through the public review process.

    “They’re now looking at how to create mixed-use developments that would include self-storage and manufacturing space,” said Michael Woloz, a lobbyist with the firm Connelly McLaughlin Woloz who is working on behalf of a Bronx-based self-storage company to push back against the proposal.

    “There are things that they’ve looked at that could represent some compromise positions,” he added. “What’s old is that City Planning itself admitted that such a text amendment would increase rates for existing self-storage and impact the amount of self storage in [industrial business zones].”

    Opponents of the self-storage industry argue that the businesses provide only a few, low-paying jobs and take up valuable real estate that could otherwise be used for manufacturing. Supporters take the position that self-storage has stepped in only after manufacturing jobs have left the city for various other reasons, and that many small businesses rely on self-storage as a low-cost warehousing option.

    In recent months the New York Self Storage Association and chambers of commerce in the Bronx, Brooklyn and Queens have come out against de Blasio’s proposal. and opposition is brewing among members of the City Council.

    The City Council delegation from the Bronx, where many self-storage businesses are located, has mixed views on the industry, but regardless all eight members of the delegation have asked City Hall to hit the pause button on its zoning amendment.

    Along with Borough President Ruben Diaz Jr. the delegation wrote a letter to the Department of City Planning last week saying they hadn’t been properly consulted when the city was drafting its proposal.

    “To be clear, the Bronx Delegation is hardly a monolith on the subject of self-storage,” the letter read. “Some members of the delegation see self-storage as affordable warehousing for individuals and small businesses of minimal means. Others see it as a blight on waterfront properties and a competitor with manufacturing. Even though our views might vary from member to member, the delegation stands united in calling for a new beginning.”

    For now, the political debate over self-storage seems to have shifted from manufacturing jobs to focus on the industry’s customers. Self-storage’s boosters say that facilities largely serve local residential residents without large homes and small businesses such as landscapers.

    The political fight may boil down to who uses self-storage facilities. Supporters say that a large portion of self-storage customers are small businesses. But detractors are painting an image of Manhattan yuppies renting space in the boroughs to store skis and relief from their bulging closets.

    In April, Diaz Jr. and Forest Hills Council Member Karen Koslowitz announced they planned to introduce legislation that would require self-storage facilities to report customers’ zip codes to the city in order to “provide a window into the universe of customers these facilities serve.”

    Should de Blasio’s measure pass, it would squeeze new supply in an already extremely tight market. The New York metro area has 3.5 square feet of self-storage per person, compared to the nationwide average of 7.2 square feet, making it the most under-served market in the country, according to a report CBRE released last year.

    Kars 4 Kids is known for a radio jingle that promises the proceeds from donated cars will go to fund charity programs for children. But the News 4 I-Team has learned the nonprofit has used a significant portion of donor funds to invest in risky real estate ventures that appear to have nothing to do with cars or kids.

    Financial statements for two nonprofits associated with Kars 4 Kids show the charity lost more than $5 million on real estate investments in 2010.

    In the same time frame, Kars 4 Kids spent about $6 million on programs for children.

    Kars 4 Kids is the public name for two lesser-known entities called JOY for Our Youth, Inc. and Oorah, Inc.

    According to public disclosures made by Oorah and JOY, Kars 4 Kids lost $2.5 million on a proposed outlet mall near the Outerbridge Crossing on Staten Island.

    The charity also lost more than $2.3 million on two failed high rise condominium towers in Jersey City known as The View I and II.

    Additionally, the charity invested $500,000 on a mixed-use development project in the Sanhedria neighborhood of Jerusalem, Israel. The property was subsequently foreclosed upon and repossessed.

    Doug White, a philanthropy expert who teaches at Columbia Univeristy, said charities are supposed to invest cautiously, using what is known as the prudent investor standard. He said a responsible charity might invest 2 to 3 percent of its assets in real estate ventures.

    In 2010, Kars 4 Kids invested and lost more than 15 percent of its net assets on real estate ventures.

    Hank Sheinkopf, a spokesman for Kars 4 Kids, said the failed real estate investments were part of an attempt to build an endowment for the nonprofit so that the charity can expand its services to children in the future.

    We believe real estate will return to value, he said.

    The charity said in a statement that the investments mentioned were vetted and executed based on professional advice, and that they met internal guidelines. Every transaction, the charity said, was scrutinized by our auditors and was authorized by its board.

    Because Kars 4 Kids is the public name of the two lesser-known entities, tracking its spending can be difficult.

    Oorah was founded by Staten Island Rabbi Chaim Mintz. His charitable mission has been to introduce non-observant Jewish children to Orthodox Judaism.

    Neither the Kars 4 Kids radio advertisement, nor the charity s outdoor billboards mention the donations actually fund a religious purpose.

    In 2009, attorneys general in Pennsylvania and Oregon forced Oorah to pay $130,000 in fines for failing to disclose the religious purpose in ads.

    When those questions have been raised by appropriate officials, appropriate settlements have been made by Oorah, said Sheinkopf.

    Since the settlements were announced, Oorah has changed its website to reflect the religious purpose.

    In fact the website shows, very clearly, what kind of people are receiving the benefits of those cars for kids as an attempt almost to say I’m sorry, and to ensure in the future no one has any question about where that money is going, Sheinkopf said.

    Aside from disclosures regarding the failed real estate investments, the financial statements filed by Oorah and JOY indicate attorneys general in both New York and New Jersey were also investigating the charity in 2010.

    News 4 reached out to both offices. Representatives declined to elaborate, or say whether the inquiries were closed.

    What is a life estate?

    The term “life estate” refers to property that is owned by an individual only through the duration of his or her lifetime. Therefore, it’s always for an indefinite period of time. We usually encounter life estates when dealing with real estate. When you have a life estate, you are called the “life tenant.” For example, you can sell or give your home to your children, but retain a “life estate,” thereby reserving the right to live in, use, enjoy, and control the home until you die. Your children would be called the “remaindermen.”

    The remainderman have an interest in the property, but they do not have the right to occupy it or rent it out. The life tenant has full control during her life of everything but selling or mortgaging the property. She can use it, rent it out and make improvements on it. She also has the legal responsibility to maintain the property. If she wanted to sell or mortgage the property, the remaindermen would have to agree and and sign off on the papers. In the event of a sale, the remaindermen would receive a portion of the proceeds based on tables that factor in the life tenant’s age and current interest rates. The older the life tenant, the smaller her share and the greater the share of the remaindermen.

    Why would I want a life estate?

    Probate Avoidance: A life estate is a way to pass your home to your children or other beneficiaries without going through probate. If you own a home and the title is in your name alone at death, it will have to go through probate. Keep in mind that having a will does not avoid probate and simply tells the court how to distribute the property in your estate. A trust, however, does avoid probate, as does property held in joint names with rights of survivorship or by spouses as tenants by the entirety.

    Tax Planning: Also, retaining a life estate in your home means that it remains an asset of your estate for estate tax purposes and allows your children to receive what is known as a step-up in basis of the real estate. This means they inherit the property at the date of death value, not the value as of the date upon which you acquired the property. So, when your children sell the property, they should be able to avoid capital gains, unless of course, the property appreciates to a value greater than the date of death value prior to the sale.

    Protection for long-term care purposes: We often use life estates as a way to preserve the home for long-term care planning purposes. Without providing all of the details relative to the MassHealth rules, this type of transfer will trigger the five-year waiting period for eligibility. After the five-year transfer period, the property should be protected. However, a lien may be placed on the property, but only up to the value of the life estate and not the entire value of the property.

    What are my responsibilities when I have a life estate?

    When you are a life tenant, you are still responsible for paying the mortgage, property taxes and insurance, and making repairs to the property.

    Are there any problems with life estates?

    There are problems that may arise and it’s important to fully understand the following risks:

    A life tenant, you may not easily sell or mortgage property with a life estate interest. The remainderman must all agree if you decide to sell or borrow against the property. In addition, if the property is sold, the remainderman could demand a share of the proceeds equal to what their interest is determined to be at that time.

    You cannot simply remove or change a name once it is on a deed to real estate like you can change the beneficiary on a life insurance policy or bank account.

    Once any remainderman is named on the deed to your house, he or she has an interest in the home and his or her legal problems could become yours. For example, if your child, who is a remainderman, is sued or owes taxes, a lien could be filed against your home. Your child’s interest in the home is not protected if he or she files bankruptcy. If your child gets a divorce, his or her spouse could claim all or part of your child’s interest in your home. Should your child die before you do, the child’s estate would have to go through probate unless at least one other remainderman was listed as a joint tenant. However, while these claims may be made against the property, no one can kick you out of it during your life.

    As touched upon above, giving away an interest in property could disqualify you from receiving assistance from MassHealth should you require long-term care for five years. In addition, if you and the remaindermen were to sell the property while you’re in a nursing home, the state could have a claim against your share of the proceeds for payments it has made on your behalf.

    As with most planning tools, a life estate can be very useful with valuable benefits, but it is not for everyone. In many cases, the potential problems might easily outweigh the benefits. As the law in this area is complex, it’s important to talk to a lawyer who knows this area of the law well.

    Kars 4 Kids is known for a radio jingle that promises the proceeds from donated cars will go to fund charity programs for children. But the News 4 I-Team has learned the nonprofit has used a significant portion of donor funds to invest in risky real estate ventures that appear to have nothing to do with cars or kids.

    Financial statements for two nonprofits associated with Kars 4 Kids show the charity lost more than $5 million on real estate investments in 2010.

    In the same time frame, Kars 4 Kids spent about $6 million on programs for children.

    Kars 4 Kids is the public name for two lesser-known entities called JOY for Our Youth, Inc. and Oorah, Inc.

    According to public disclosures made by Oorah and JOY, Kars 4 Kids lost $2.5 million on a proposed outlet mall near the Outerbridge Crossing on Staten Island.

    The charity also lost more than $2.3 million on two failed high rise condominium towers in Jersey City known as The View I and II.

    Additionally, the charity invested $500,000 on a mixed-use development project in the Sanhedria neighborhood of Jerusalem, Israel. The property was subsequently foreclosed upon and repossessed.

    Doug White, a philanthropy expert who teaches at Columbia Univeristy, said charities are supposed to invest cautiously, using what is known as the prudent investor standard. He said a responsible charity might invest 2 to 3 percent of its assets in real estate ventures.

    In 2010, Kars 4 Kids invested and lost more than 15 percent of its net assets on real estate ventures.

    Hank Sheinkopf, a spokesman for Kars 4 Kids, said the failed real estate investments were part of an attempt to build an endowment for the nonprofit so that the charity can expand its services to children in the future.

    We believe real estate will return to value, he said.

    The charity said in a statement that the investments mentioned were vetted and executed based on professional advice, and that they met internal guidelines. Every transaction, the charity said, was scrutinized by our auditors and was authorized by its board.

    Because Kars 4 Kids is the public name of the two lesser-known entities, tracking its spending can be difficult.

    Oorah was founded by Staten Island Rabbi Chaim Mintz. His charitable mission has been to introduce non-observant Jewish children to Orthodox Judaism.

    Neither the Kars 4 Kids radio advertisement, nor the charity s outdoor billboards mention the donations actually fund a religious purpose.

    In 2009, attorneys general in Pennsylvania and Oregon forced Oorah to pay $130,000 in fines for failing to disclose the religious purpose in ads.

    When those questions have been raised by appropriate officials, appropriate settlements have been made by Oorah, said Sheinkopf.

    Since the settlements were announced, Oorah has changed its website to reflect the religious purpose.

    In fact the website shows, very clearly, what kind of people are receiving the benefits of those cars for kids as an attempt almost to say I’m sorry, and to ensure in the future no one has any question about where that money is going, Sheinkopf said.

    Aside from disclosures regarding the failed real estate investments, the financial statements filed by Oorah and JOY indicate attorneys general in both New York and New Jersey were also investigating the charity in 2010.

    News 4 reached out to both offices. Representatives declined to elaborate, or say whether the inquiries were closed.
