Is Surrogacy Legal in New York? – Can Parties Enter in to a Surrogacy Contract?

Many potential clients that live in New York come to us and ask the question of, “Is Surrogacy legal in New York?” Like most things, the answer is that it depends. First and foremost if your surrogate does not live in New York and the birth will not take place in New York, you should look to the laws in the State where the surrogate lives. If the surrogate lives in New York, you have to pay attention to New York law.

The New York legislature has declared commercial surrogate parenting contracts void, unenforceable and contrary to public policy. Strict civil fines and/or penalties are assessed for violation of the statute. As such, any type of surrogacy where the surrogate gets compensated is prohibited. The prohibition in New York stems from the famous Baby M case that occurred in New Jersey where there was a long legal battle when the surrogate did not want to give up the baby after it was born. Shortly after this case, both the New York and New Jersey legislatures padded laws that prohibited commercial surrogacy.

While there is always a risk that a surrogate may have a change of heart, the cases that deal with surrogacy are not really applicable to the way surrogacy is conducted today. That is, in the past (and in the Baby M case), the surrogate was also the egg donor so had a genetic connection to the child. Today though, almost all surrogacy is done where a fertilized egg is placed in the womb of the surrogate and the fertilized egg does not have any genetic material from the surrogate. Even though this is the case, the laws in some States like New York and New Jersey have not yet changed but there is active discussion in the legislature to modify the surrogacy laws.

What is permitted in New York is surrogacy arrangements that are altruistic and uncompensated and these are often referred to as compassionate surrogacy arrangements. As such, a friend or family member could carry a baby for someone else but the parties have to adhere to very strict guidelines. While a document can be drafted to outline the intentions of the parties (usually called a Memorandum of Understanding in New York), you should note that the document will have the following disclaimer. “This MEMORANDUM is not a contract and is not binding or enforceable in any court of law.” What this means is that parties to uncompensated surrogacy contracts cannot have their contracts enforced by New York courts if a dispute arises. Instead, the determination regarding custody and parental status will be guided by family law, not contract principles. The meaning of this is that the document is not a contract and cannot be enforced. Notwithstanding the fact that the document cannot be enforced, it is still a good idea to draft a document that clearly outlines the intentions of the parties.

The document will also contain explicit wording that the arrangement in no way constitutes payment for genetic material, for a child, or for relinquishment of a child or sets out any payment, compensation or remuneration arrangements other than what is expressly allowed by New York Domestic Relations Law, Article 8, § 123(a) and (b). A key point is that it is made clear in the document that the parties do not intend to exchange funds (and they should mean it).

All parties should also consult with independent legal counsel regarding this compassionate surrogacy arrangement and the potential legal consequences of this arrangement and the document will contain many of the following provisions (this is NOT an complete list):

• Declaration of intentions including what the parties are trying to accomplish and the purpose and intent of the agreement
• A description of the assumption of risk including that the Surrogate is aware of the risks of pregnancy and knowingly and willingly undertakes them
• Acknowledgement that the Parties have had independent advice and have been informed by their respective attorneys that the legislature or Courts may declare that the Agreement is void as against public policy, in whole or in part, or may hold the Agreement unenforceable in whole or in part
• Acknowledgement that parties warrant that they understand the law and that the surrogacy is a compassionate one
• Details related to Financial Issues including that the Intended Parents pay for health care and will issue payment directly to healthcare providers whenever possible
• What should occur Before pregnancy
• What should occur during pregnancy – eg. What do the parties intend in terms of activities for the surrogate during pregnancy
• What should occur after pregnancy – eg. Can the surrogate breast feed
• Health precautions – What screening and tests should be completed
• How embryo or other transfer will take place
• Details regarding health care (eg. Physician used, confidentiality, etc.)

There are several other things that the document would cover but the above list gives you an idea of the types of provisions that are included. It is essential to get a qualified attorney to draft the document for you given the document may later be used in the adoption proceedings and both parties want to be protected.

Given the importance of this major step in your life, the complexity of the law, the expense and the potential for saving money, you should get an experienced lawyer to assist you. While a lawyer from an agency will represent you for some of the legal aspects, that will often be the same person that is looking out for their own interests. Also, one of the key areas you need an independent lawyer is to negotiate your contract with the agency. Finally, surrogacy law is a tricky area and there are many things a good lawyer can point out to you that will ultimately save you far more than you will ever pay the lawyer.

Most car leasing deals last for periods of two, three, or four years, while the benefits of daily car rental can be lost over periods in excess of a couple of months. So which option should you choose if you require a vehicle for a period of time that falls between these two car finance options?

The answer can be short-term car leasing (also known as ‘short-term contract hire’). This guide to short-term car leasing will explain how the process works and help you decide if it’s right for you.

What is short-term car leasing?

Short-term car leasing fills the void in the market between daily rentals and traditional car leasing. The average length of a short-term car leasing deal is three and 12 months, though some companies do offer rolling contracts for as little as 28 days.

Broadly, short-term car leasing works in the same manner as a traditional car leasing deal but, as the name suggests, over a shorter period.

This means that you will make payments (usually monthly) based on the difference between the value of the car at the start of the term (its retail value) and the value of the car at the end of the term (its residual value). You will also be asked to stick to a strict mileage limit which will be used by the leasing company to determine the residual value. If you exceed the mileage limit you are likely to be penalised as this will affect the vehicle’s depreciation.

At the end of the short-term car leasing period, you simply return the vehicle to the leasing company and walk away. There is no option to buy the vehicle although if you choose, you could take out another short-term car leasing deal.

What are the pros and cons of short-term car leasing?

There are many advantages to a short-term car leasing deal including:

  • Regularly update vehicles – With a short-term car leasing deal you can update the vehicle you drive, or your fleet, as regularly as every three to 12 months depending on when each leasing period expires.
  • Better vehicles – As luxury vehicles tend to hold their value comparatively well, you could find that previously unaffordable vehicles become available to you with short-term car leasing.
  • Flexible leases – Cars can be leased on rolling 28day contracts which can provide great flexibility.
  • Ideal for fluctuating requirements – If you hire staff on probationary periods or your vehicle needs differ from month to month, short-term car leasing can provide an ideal solution.
  • Fixed cost motoring – Short-term car leasing allows you to budget for the period of each lease knowing exactly what your monthly outgoings will be.
  • Optional maintenance packages available – As with long-term leases, maintenance packages can be secured.
  • Road Fund Licence – Will be incorporated into the agreement.

The downsides to short-term car leasing are the costs. Though it will generally be more cost-effective to take out a short-term car lease than a long-term daily rental, the fact is that most new cars depreciate most rapidly during their first twelve months – the length of a typical short-term car lease. Therefore, payments are unlikely to be as cost-effective as long-term deals.

That’s why it’s crucial to shop around to find the best deal. Also make sure you consider all costs – it will be necessary for you to secure your own comprehensive insurance deal, and watch out for hidden fees such as additional taxes, early termination charges, administration fees and acquisition fees.

Look for short-term car leasing deals that incorporate maintenance packages, offer low monthly payments and make sure you do not exceed the mileage limit or cause any unnecessary wear and tear.

Who is short-term car leasing right for?

Short-term car leasing is a good stop-gap for motorists while they work out alternative means of transport. It’s also well-suited to companies that have fluctuating needs.

All new clients will be required to sign our updated contract outlining the details specific to your event. You may print the basic pages here, however a detailed contract will be done for each booking.

Lessee to include : Client 1 and client 2 as well as any 3rd party they request to provide payment for services, such as parents or relatives.

Date reservation. Contract is for the day of one event and includes set up and breakdown days as needed. Request for additional days for the event or secondary event are subject to additional fees. Clients may not share or sub-lease with other client events at the same location.

EWD reserves the right to adjust setup and breakdown dates and/or times to fit its schedule. Additional fees may apply for locations that require immediate breakdown after event, or any other surcharges to vendors.

Payment Due Date. Estimated charges over are due in full as follows and are non-refundable.

EWD reserves the right to deny changes to the order or provide additional services that can not be reasonably performed in the time frame allotment scheduled for the event set up. Any request that are unsafe or illegal will also be denied.

Cancellation of the event by the client will result in the forfeit of all prepaid amounts as outlined due above. Notice must be given in writing by both clients listed in this contract. The contract may be rewritten with one client removed if necessary.

EWD reserves the right to cancel this contract should the clients not follow the payment schedule.

Exception to cancellation policy for ceremony chairs only. Orders for only outdoor ceremony chairs that are cancelled due to weather the day of the event will be refunded 50% of the invoice as long as the chairs have not been delivered and set up. Once the chairs are on location, no refund will be give regardless of use.

What Is A PhD?

Brief definition

In the UK, a PhD stands for Doctor of Philosophy , sometimes referred to as a doctorate . It is the highest level of degree that a student can achieve. At some institutions, including Oxford University, a Doctor of Philosophy is known as a DPhil. It is distinct from professional doctorates such as an Engineering Doctorate (EngD).

PhD Entry requirements

An undergraduate degree is a minimum requirement and many will also require a master s degree (such as an MA, MSc or MRes). Some funded PhD s will be on a 1+3 basis, which is one year of a master s plus three years of PhD funding.

How to apply for a PhD

Prospective PhD students are usually expected to submit a research proposal to the department they wish to undertake their study in. Some departments will encourage students to discuss their ideas with an academic working in that field first. The proposal will outline what they intend their research to investigate, how it relates to other research in their field and what methods they intend to use to carry out their research. Some PhD s however, particularly in the sciences, are advertised as studentships where the research aims are more prescriptive.

How long is the course?

A PhD usually lasts three years (four for a New Route PhD see below), or rather, any available funding usually lasts for that time. Students may be able to take extra time in order to complete their thesis but this will usually be at their own expense. For part-time, self-funded students, a PhD can take up to seven years.

What s involved

A PhD usually culminates in a dissertation of around 80,000-100,000 words, based on research carried out over the course of their study. The research must be original and aim to create new knowledge or theories in their specialist area, or build on existing knowledge or theories. Many departments initially accept students on an MPhil basis and then upgrade them to PhD status after the first year or two, subject to satisfactory progress. Students who are not considered to be doing work appropriate for PhD level can instead submit a shorter thesis and gain an MPhil.

There is little taught element in a PhD students are expected to work independently, supported by their department and a supervisor. There may be seminars to attend and/or lab work to complete, depending on the subject. During their study, students will try and get academic papers published and present their work at conferences, which will allow them to get feedback on their ideas for their dissertation.

New Route PhD

Introduced in 2001, the New Route PhD is a four-year programme that combines taught elements, including professional and transferable skills, with the student s research. PhD graduates who go on to work in academia usually start off by undertaking postdoctoral research and then a fellowship or lectureship.
