What bad things can happen?

There are several bad things that can happen to car renters in California:

  • Third Party Liability. Damaging someone else (bodily injury or property damage) and getting sued by the injured person. The potential loss depends of course on the amount of damage caused, culpability of the driver (racing cars while intoxicated will not help), and attorney and court related fees. This liability can be very large and drivers who have caused a lot of pain and suffering have been successfully sued for many thousands to millions of dollars.
  • Theft if renter is careless. Having the car stolen when the renter has NOT exercised “ordinary care” (e.g. leaving the keys in the car and doors unlocked). The charge depends again on the fair market value of the car and any administration charges (including loss of use). Charges could be as as high as $40,000 when renting a mid-sized car.
  • Collision/Loss for whatever reason. Damaging the rental car (regardless of who is at fault) and getting charged by the rental company for repairs and loss of use. The charge depends on the damage to the car (up to fair market value), how long it takes to repair the damage and any administration charges (including loss of use). However, the charges are capped by California Civil Code Section 1936 if the car is vandalized but not stolen: The most the renter is responsible for is $500.
  • Personal Accident Medical Costs. Getting personally hurt from an auto accident and having to pay medical bills. The risk depends on whether someone else is at fault and has money/insurance to reimburse the renter; and also the extent of the injuries. A standard emergency room visit with X-rays can easily cost $2,000 while emergency surgery may cost over $50,000.
  • Personal Effects Loss. Having personal items (e.g. luggage) stolen or damanged while in the rental car.

Besides the monetary loss, there is the hassle of dealing with rental car companies, lawyers and paperwork needed to resolve these issues. Hopefully, nothing bad will ever happen but it is important to understand what can go wrong first. Then decide: Do I care about these bad things enough to pay the extra $$ to insure against it?

California Law Requiring Insurance

According to California DMV, The following minimum liability insurance is required for private passenger vehicles:

  • $15,000 for injury/death to one person. (Also known as bodily injury liability)
  • $30,000 for injury/death to more than one person.
  • $5,000 for damage to property. (Also known as product damage liability)

Third party liability insurance compensates a person other than the driver for personal injury or property damage. Comprehensive or collision insurance does not meet vehicle financial responsibility requirements. It covers the situation where you hit and break someone’s leg (bodily injury) or run over someone’s fence (property damage).

The only required insurance coverage when renting cars in California is third party liability. Of course, many people choose to get insurance over and above what is legally required. Drivers must also carry proof of liability insurance (your own insurance card or the car rental contract if liability coveerage was purchased) as that is required by law.

What is automatically covered?

For California, rental car companies do not automatically provide any liability protection to the renter as part of the standard rental agreement. However, some (e.g. Hertz) may provide the minimum primary liability protection to international customers (driver’s license indicates an address outside the USA) renting in California.

This means drivers need to provide their own liability insurance when renting in California. In general, US residents should already be covered by their regular auto insurance but drivers need to confirm that they have the minimum level of liability insurance from their own insurance company. If not, renters will need to purchase purchase liability insurance (LIS or SLI) through the car rental company, or a non-owner liability policy through an agent or your favorite insurer like Geico, Progressive, etc).

According to California Civil Code Section 1936, the renter is covered for theft (and vandalism damage as a result of theft) as long as the renter has exercised ordinary care. The renter is also covered for vandalism with a $500 deductible in cases other than theft. So purchasing additional coverage for theft and vandalism (assuming the renter plans to exercise ordinary care) is typically not needed.

The other risks (collision damage to the rental, theft when renter is careless, personal accident medical or having personal effects damaged/stolen) are not automatically covered by rental car companies. So while not required by law, the renter has the option to purchase coverage to protect against the risk. In many cases, the renter already has coverage through somewhere else (e.g. their own auto insurance or personal liability policy, their health or life insurance, or their credit card company).

The rates for additional coverages are typically not included in price quotes from direct booking sites in the US whereas International visitors who book rental cars through overseas booking services (e.g. http://www.hertz.com.au, http://www.avis.co.uk/ or rentalcars.com) will typically find 3rd part/supplementary liability insurance and Collision/Loss Damage Waiver bundled into the daily rate. So, always check terms and conditions for quotes when booking or comparing rates.

Exclusions and limits to coverage

There are some important exclusions to note in some of the coverages sold by car rental companies.

Liability insurance sold by rental car companies will typically cover liability up to $1 million. This means if a renter is successfully sued for $5 million, the insurance company will pay the $1 million and the renter is personally responsible for the rest (less any other insurance the renter has).

Personal Accident Insurance (which covers the renter’s medical bills) typically has an upper limit that is low — only $2,500 for Hertz and Avis. Note that the renter is typically covered only for accidents while in the car and not while falling on a hike or getting food poisoning in a restaurant. Other exclusions may also apply. Visitors to the United States who need temporary health insurance that cover them inside or outside a car for more than $2,500 can obtain them from different insurance agencies that specialize in travel insurance for overseas visitors (e.g. moneysupermarket.com and many others).

It is also important to note exclusions to the Loss Diamage Waivers (LDW/CDW) sold by car rental companies. LDW is not insurance; it is a waiver of the right for car rental companies to sue for damages. Typical exclusions which invalidates LDW (in California) include (but may not be restricted to):

  • Intentional damage to the rental car
  • Towing or pushing anything
  • Driving while intoxicated or under the influence of drugs
  • Driving in a reckless, wonton or dangerous manner’
  • Using the car for commercial hire, or while committing a felony
  • Driving on unpaved roads (if the damage or loss is a direct result of the road/driving conditions)
  • Driving outside the US or Canada
  • Use of car by an unauthorized driver (other than the renter or spouse of legal age with valid drivers license)

This means that any damage to the car under the circumstances above will not be covered by LDW. Each rental car company has different rental agreements so read your rental car agreement for the exact exclusions. If you are covered by your own insurance, understand the exclusions of your own insurance when deciding whether there is duplicate coverage.

Bottom Line: Which Car Rental Coverage is required?

Third party liability is ALWAYS required so be sure you have that. For others, decide whether you want to pay the additional charges BEFORE you walk up to the rental counter. For many visitors from overseas, collision damage waivers provide peace of mind and California regulates the price so there should be no difference in the cost of coverage among car rental companies.

Decide before hand so you won’t be confused and end up paying for coverage you don’t need or want. For those who HATE being “sold” additional insurance, consider signing up for frequent renter programs where insurance coverage decisions are made before hand and all you do is pick up the car and skip any “hard sell tactics”.

For even more coverage, consider a business commercial umbrella policy. It picks up where your business auto liability, general liability or other liability coverage stops. Commercial umbrella insurance is an inexpensive way to get extra coverage against bodily injury and/or property damage.

For example, if your current commercial truck liability insurance policy covers you for $1 million and you are successfully sued for $1.5 million, your commercial umbrella coverage can pay the outstanding $500,000 – so you don’t have to.

Minimum and maximum limits on auto liability insurance

A limit is the maximum dollar amount your insurance may pay per event. For example, if you have a property damage limit of $10,000 and cause $15,000 in damages in a covered accident, you are responsible for the excess $5,000.

If you carry only the state-minimum required liability car insurance with the lowest limits and you’re responsible for a bad covered accident, you would have to pay the balance of the claims that exceed your policy limits. It’s smart to select the highest auto insurance liability limits you can comfortably afford so you have adequate coverage if the unthinkable happens.

How much liability auto insurance you’re required to buy depends on the state where you reside. How much you buy beyond the legal minimum depends on your finances and assets. If money is tight, you might need to settle for state minimum limits, but it can be risky. If you have sizeable assets, you may want to consider higher limits, like those found in a personal umbrella policy that offers an extra layer of protection.

Insurance Requirements

In Tennessee, you are required to carry liability insurance to cover injuries or damages you may cause to someone after a car accident.

The required minimum limits of your liability car insurance are:

  • $25,000 for each injury or death per accident.
  • $50,000 for total injuries or deaths per accident.
  • $15,000 for property damage per accident.

Optional Car Insurance

If you wish to protect yourself beyond the required auto insurance minimums, you might want to consider purchasing optional types of car insurance.

Most Tennessee car insurance companies offer the following coverage options:

  • Collision – Covers accident-related damages to your car.
  • Comprehensive – Covers non-accident related damages to your car, such as those caused by weather or vandalism.
  • Uninsured motorists – Helps cover costs associated with accidents with uninsured drivers or those with too little insurance.
  • Medical payments – Helps pay for your medical bills after an accident.
  • Rental car.

NOTE: If you have a car loan or lease, your lender may require you to have collision and comprehensive coverage.

Proof of Insurance

In Tennessee, you must provide proof of insurance when you are:

  • Pulled over by a police officer.
  • Involved in a car accident you are required to report. You must report accidents that involve:
    • Any injuries.
    • Death.
    • Over $400 in property damages.

You can report a car accident by completing the Owner/Driver Report (Form SF-0395) form and mailing it in to the Tennessee Department of Safety.

Legal proof of insurance includes:

  • Your insurance ID card.
  • Insurance binder.
  • Policy declaration page.

You can obtain any of the above from your Tennessee car insurance provider. Remember to ask for new documents each time you renew your policy.

You do not need proof of insurance to register your car or to obtain your driver’s license.

Insurance Violation Penalties and Fines

If you are caught driving without car insurance or evidence of financial responsibility, you face a Class C misdemeanor, which could include:

  • Fines.
  • Suspension of your driver’s license.
  • A STOP on your car, keeping you from renewing your registration.

To have a STOP removed from your vehicle registration, you must:

  • Have your driver’s license reinstated.
  • If you have had your case dismissed by showing your proof of insurance before your court date, you must also send your proof of insurance to the DOS through one of the methods listed below.

Tennessee Automobile Insurance Plan

Auto Insurance Markets

For those holding valid Ohio drivers licenses, there are three avenues available for auto insurance:

The voluntary standard market, where insurance is obtained at competitive rates through a selected insurance company without state assistance.

The voluntary nonstandard market, where insurance is obtained through a selected insurance company, but with a higher premium, based on higher risk factors such as an imperfect driving record or insuring a specialty vehicle.

  • The involuntary residual market, known in Ohio as the Ohio Automobile Insurance Plan (OAIP), is a state plan that guarantees liability coverage for those who have difficulty obtaining insurance through the voluntary standard and nonstandard markets.
  • Ohio s strong voluntary market

    Close to 100% of Ohio s 7.9 million drivers and their vehicles are eligible for coverage through insurance companies, thus making it one of the most favorable private passenger auto insurance markets in the country. According to a 2003 study by the National Association of Insurance Commissioners, Ohio s 2001 average auto insurance premium was nearly $135 less than the US average, with auto premiums lower than all but nine states (click here for more information). This is based on a full coverage policy.

    Due to the competitive nature of writing voluntary standard insurance within the state, it s advisable to compare the services and rates of various companies and agencies prior to purchasing insurance. According to the Ohio Department of Insurance, there are 974 P/C insurance companies licensed in Ohio. A.M. Best reports that 420 companies were writing private passenger auto insurance in the Buckeye state in 2002. Only Illinois has more auto insurance writers than Ohio. Ohio s total auto premium volume ranks eighth in the nation.

    Voluntary nonstandard market

    Nonstandard markets were originally developed because of the need to fairly assess policyholders based on their driving records. Now it s also a niche market for specialized vehicles such as high-powered sports cars and custom-built vehicles.

    Four out of every five drivers have coverage through the voluntary auto insurance market.

    In recent years, the lines between standard and nonstandard markets, and various levels of risk, have begun to blur. High risk drivers are finding it easier to secure coverage through insurance companies rather than reverting to state-run pools, because many insurers also offer insurance specifically geared toward the nonstandard market through separate subsidiaries and/or risk categories. There are also small specialty insurers whose only business is the nonstandard market.

    According to a report by Conning Insurance Research Publications (Hartford, CT), premiums written for high-risk drivers totaled $4.4 billion in 1992. A.M. Best data shows direct premiums written in the nonstandard auto insurance market grew nearly seven-fold to $30.6 billion in 2002. In comparison, the total auto insurance market was $88.4 billion in 1992, rising to $143.8 billion in 2002 about a 61% increase. Table 2 below shows the nonstandard market in comparison to the total direct premiums written for the private passenger market for 1995 2002.

    In 2002 direct premiums written for nonstandard auto market represented about one-fifth of the total private passenger auto insurance market.

    Most nonstandard auto insurers use independent agents as their distribution method, although the Internet and toll-free numbers are distribution methods also employed by insurers.

    Involuntary residual market

    Each state and the District of Columbia manage their own involuntary high risk insurance plans. According to the Automobile Insurance Plans Service Office (AIPSO), about 2.5 million of the over 171 million insured private passenger cars in the US were insured through the involuntary market in 2001 about 1.45%. This is down from 1.54% of all insured private passenger vehicles insured through state plans in 1999.

    The number of cars insured through these plans can be viewed as a meter in determining the availability of voluntary insurance within a state. The smaller the number of assignments in a state s plan, the greater the number insured through the voluntary insurance market. In states where rates are held down artificially through legislation, more drivers are insured through the involuntary market.

    Ohio Auto Plan

    Ohio Auto Insurance Plan statistics show that only 16 passenger vehicles (seven private passenger and nine commercial) of the state s 8.5 million-plus private passenger registered vehicles were assigned to the plan in 2002, making one of the smallest plan in the country. Table 1 provides OAIP private passenger vehicle activity for 1995 2002. For auto plan statistics by state for 2001, click here.

    OAIP eligibility requirements include a valid drivers license and a car in safe operating condition. In the plan, each insurance company operating in Ohio is assigned applications in proportion to its auto insurance premium volume.

    OAIP private passenger vehicle coverages include bodily injury liability, property damage liability, uninsured/underinsured motorists, uninsured motorists property damage, medical payments, and comprehensive and collision with deductibles. The plan guarantees liability coverage, with most qualifying for additional coverages as well.

    Premiums in the involuntary residual market typically start about 50% above the base rates for drivers in the voluntary market. The worse the driving record, the higher the rates.

    The FAIR Plan and High-Risk Insurance

    High-risk insurance is when the insurance company has assessed claims risk at a location and has determined that there is a high probability that a claim will occur based on either geographic data, maintenance, or on loss history for the location or specific home.

    Where Do You Get Insurance for a High Insurance Risk Area?

    Standard insurers do not specialize in high-risk properties and therefore will often refuse to insure them, by either not insuring them at all, or by advising that they will not renew a high-risk location once the insurance policy term is up.

    What Makes a Home High Risk?

    • If you live in an area that is prone to natural disasters, like tornado alley, or where there is a high incidence of hurricanes or windstorms, your property may be considered high risk.
    • If you live in an area that is prone to high crime levels, vandalism or theft
    • If your home has not been renovated or is in disrepair
    • If you have had high incidences at your residence of claims

    What to Do If You Have Trouble Finding Home Insurance

    If you are purchasing your first home or a new property and your initial inquiries do not result in finding an insurance company, try asking your realtor if they know of insurance companies or brokers in your area that will write policies in the area.

    Insurance brokers have access to many different insurance companies and will work to find you something. You may still be able to find a policy with a private insurer that is comfortable and offers good coverage. The FAIR Plan should be used as a last resort.

    Consider the reasons that you are being refused insurance and try negotiating with the insurance company. Very often if you make adjustments or repairs, or consider higher deductibles, you may be able to obtain coverage. Make sure you try everything with a few standard insurers before going to the FAIR Plan.

    FAIR Plan is Not Guaranteed Insurance: Conditions of the FAIR Plan

    According to the Insurance Institute, even the FAIR Plan has conditions.that must be met. Just because you have a high-risk home, it does not mean the fair plan will accept you. You may be asked to limit the risk of fire, theft or water damage by installing anti-theft or alarm devices, you may be asked to install backup valves, or repair your roof, and in some cases replace your wiring. If these types of conditions would have made you eligible for standard insurance, you are probably better off doing your necessary repairs and sticking with a standard insurance company.

    When to Look for FAIR Plan Insurance

    If you have exhausted all the options outlined above, and you can t seem to find an insurance company to accept your risk, then you have the option of applying for insurance with the FAIR Plan. Keep in mind, however, if the reason for refusal to insure your property is not due to matters beyond your control, like regional weather patterns, even the FAIR Plan has the right to refuse coverage if you do not adhere to their recommendations. The situation varies case by case, so you will want to contact them directly to discuss the conditions of the FAIR Plan as they apply to your situation. You may also be eligible for additional insurance endorsements that may improve the base coverage.

    While not considered a no-fault state, Oregon requires motorists to purchase $15,000 of personal injury protection (PIP) as part of an Oregon auto insurance policy. Regardless of who was at fault in an auto accident, PIP takes care of (up to your limits):

    • Reasonable medical expenses
    • Loss of earnings of up to 70 percent of your wages, up to $3,000 a month for 52 weeks (beginning on day 14 of your disability)

    Besides PIP, an Oregon car insurance policy must also contain liability insurance: bodily injury liability of at least $25,000 per person and $50,000 per accident and $20,000 for property damage liability.

    Uninsured motorist and underinsured motorist are both required as well. They help pay medical expenses arising out of injuries received in an auto accident where the at-fault driver was either without insurance or without adequate insurance coverage.

    Pay-as-you-drive (PAYD) plans: Oregon not only has approved PAYD auto insurance plans, but encourages car insurance companies to offer such programs by offering tax credits for insurance companies that have a mile-based or time-based rating plan since they reward people who drive less and thus reduce greenhouse gases, fuel consumption and of course accidents.

    After an accident: You must file an accident and insurance report within 72 hours of an accident if it meets certain criteria. There are also certain rules to follow in Oregon if you hit an unattended vehicle or animal. If you hit an unoccupied vehicle and cannot find the owner, you must leave a note with contact information including your name and address. If you hit and injure an animal, you must stop and give reasonable attention to the animal depending on traffic hazards and the animal s behavior, moving the animal from the road if possible. You must report the injuries to the animal s owner or the police.

    Uninsured motorist penalties for Oregon: You may be fined $130 to $1,000, your license and registration may be suspended, your car may be impounded and you may be required to file an SR-22 form.

    No grace period: Any vehicle on Oregon roads needs to be currently insured, according to Oregon law. There is no grace period after buying a new vehicle when you’re allowed to be on the roads without insurance.

    Electronic proof of insurance: Oregon allows drivers to show proof of insurance during a traffic stop on a smartphone. It is one of 31 states that does so.

    Simca 1100 (1967-1981)

    La Simca 1100 est la première traction de Simca, et un véritable succès commercial : plus de deux millions d’exemplaires commercialisés entre 1967 et 1981. La Simca 1100 est le fruit d’un grand travail de réflexion chez Simca, mais aussi d’une lutte contre la nouvelle maison mère, Chrysler, qui aurait souhaité une voiture plus traditionnelle. Retour sur l’histoire de la première (at)traction de la marque.

    Simca, originellement filiale de Fiat fondée en 1936, prend son envol dans les années 1950 pour devenir indépendante et concevoir des voitures originales comme l’Aronde qui lui permettent de devenir l’un des principaux acteurs du marché automobile français. En 1958, Ford décide de vendre sa participation dans Simca, c’est l’américain Chrysler qui les rachète et qui dès lors, dispose de 25% du capital. En 1963, c’est au tour de Fiat de vendre à l’américain ses parts, Chrysler devient l’actionnaire majoritaire avec 63% de Simca.

    A cette époque, la gamme Simca comprend la 1000 nouvellement lancée, l’ Aronde et l’ Ariane vivent leurs derniers mois et furent remplacées par les Simca 1300 et 1500 à partir de l’été 1963. Mais quelques mois auparavant, au printemps 1962, Simca effectue une étude sur le marché automobile sur les quinze années à venir. Il en ressort que l’intérêt du consommateur se porte de plus en plus vers des voitures de gamme moyenne à traction avant, avec un intérieur modulable. Dès lors, Simca lance le projet VLBB (Voiture Légère Berline Break) avec l’optique de créer une voiture commercialisable à l’horizon 1966/1967.

    Le Projet VLBB vise aussi à combler le trou entre la Simca 1000 qui entre dans la catégorie des 5CV et la Simca 1300 de la catégorie des 7CV. Le cahier des charges prévoit une voiture de taille moyenne, équipée d’un hayon, avec moteur à l’avant. Aussi, les bureaux d’études vont explorer les différentes variantes du modèle dès les débuts, car dès la fin de l’année 1962, la VLBB devra être réalisée de façon à être déclinée en coupé trois portes, berline à cinq portes et break à trois portes.

    Les premiers prototypes réalisés permettent de confronter deux solutions techniques : le moteur en position longitudinale ou transversale. Dans le même temps, le bureau de style de Simca travaille sur le design de la future voiture. Durant l’été 1963, la direction de Simca opte pour un modèle à moteur transversal, le projet 928 débute. Enfin presque, il faut d’abord obtenir le feu vert de la maison mère Chrysler.

    Or, Chrysler avait une dent contre Pigozzi qui avait vendu Simca sans vendre Simca Industries (qui comprenait les forges, fonderies… indispensables à l’approvisionnement de Simca), obligeant les américains à mettre la main au porte-monnaie une nouvelle fois. De cet épisode nait une méfiance entre les équipes françaises et américaines, chacun cherchant à préserver ses acquits techniques, voir, à cacher leurs travaux. Pour le projet VLBB qui donne naissance au projet 928, les américains ont du mal à comprendre le bien fondé de ce dernier : ils sont opposés à la traction avant, et auraient préféré produire une voiture haut de gamme. Fin de non recevoir…

    Mais le Président de Simca, Georges Hereil, prend le projet 928 à cœur et continue son développement dans la clandestinité. Fin 1964, il retourne aux Etats-Unis où il use à la fois de diplomatie, de son prestige personnel (il est l’un des créateurs de l’avion Caravelle), et d’analyses extrêmement poussées sur le marché européen pour obtenir le feu vert de Chrysler. Le projet 928 débute officiellement, il a trois ans pour aboutir car la production devra démarrer en Juillet 1967.

    Pour les ingénieurs de Poissy, la tâche est rude car le projet 928 prévoit la construction d’une voiture totalement nouvelle, seul le moteur existe déjà, il sera emprunté à la Simca 1000, mais un long travail d’adaptation de cette mécanique à la traction débute. Beaucoup de choses évoluent alors du côté de Poissy, même l’outillage pour pouvoir produire la future voiture. Du sang neuf arrive également chez Simca, le constructeur débauche deux ingénieurs de talent chez Peugeot, Claude de Forcrand et François Paget.

    Le projet 928 nécessitait un travail immense pour les équipes des bureaux d’études Simca, mais celui-ci est bouclé dans les temps : les ultimes essais de validation sont effectués en Juin 1967. Simca convie également les représentants de la direction de Chrysler à essayer deux modèles de pré-série et de les comparer à la Peugeot 204. Essai concluant, tous les voyants sont au vert pour cette nouvelle voiture.

    Aussi, le design de la voiture a été arrêté depuis bien longtemps, la futur Simca s’appellera 1100 et revêt une ligne très anguleuse, à la fois moderne pour son temps mais aussi très classique. En somme, une voiture de faire l’unanimité auprès du public, quitte à être trop sage. Seuls quelques détails sont réglés à la dernière minutes, comme les pare-chocs (comme nous le prouve le cliché ci-dessous d’un mulet début Juillet 1967).

    Du côté de l’usine de Poissy, l’usine est en travaux pour préparer la chaine de montage de la future 1100, depuis quelques mois, la production globale du site en est affectée, seuls 11.500 ouvriers sur 17.000 sont maintenus au travail. L’usine doit même fermer ses portes durant deux semaines en Juillet, en plus de l’arrêt habituel de la production en Août pour les vacances d’été. Toutefois, une petite équipe reste en place pour tester cette nouvelle chaine de montage, 45 Simca 1100 LS et 2 1100 GL sont ainsi produites en Juillet 1967. Certaines de ces voitures servent alors pour les premières photos officielles du modèle.

    Durant le mois de Septembre 1967, les premières 1100GLS sont produites, elles servent à grossir le parc des Simca 1100 destinées à la présentation de la voiture, notamment pour la presse, pour laquelle une séance d’essais est organisée en Sardaigne à la fin du mois.

    Les opérations préalables à la présentation de la Simca 1100 faites, vient désormais l’heure de la présentation au public. C’est le 03 Octobre 1967 que la voiture est dévoilée au public au sein du magasin Simca sur les Champs-Elysées, quelque jours avant l’ouverture des portes du salon de Paris. Le Général De Gaulle vient même voir la voiture sur le stand Simca le vendredi 06 Octobre. Ce même jour, au Bourget, Simca organise la présentation du modèle à ses collaborateurs, concessionnaires et invités triés sur le volet.
