In the context of a car accident case, “diminished value ” refers to the difference between what your car was worth before the crash occurred, and what it is worth after it has been repaired.

The rationale behind a diminished value claim is that on the free market, someone who wanted to buy your car would probably be willing to pay less after the vehicle has been in an accident than they would have paid had the accident not occurred, even though the car has been repaired.

A Kissimmee police officer was charged after he slammed into an employee’s car in the parking lot of a Brevard County strip club and left the scene, records show.

Sgt. Bruce Connors, 36, was charged in early October with leaving the scene of a crash after ramming the car parked outside the Lido Cabaret in Cocoa Beach, records show.

He was relieved of duty 21 days later on Oct. 30 and placed on paid administrative leave. Connors, who joined the department in 2004, earns $66,000 a year.

The department has launched an internal affairs investigation of the incident. Police Chief Lee Massie declined comment.

Surveillance video of the crash shows an employee of the strip club dressed in a thong and corset running after Connors’ pickup moments after he hit rammed her 1965 Oldsmobile Cutlass sedan on Oct. 9 and sped away, records show.

The club already knew who he was and where he lived. A week earlier, Connors had been drinking there and left without paying his tab. The club has a policy that anyone running a tab must hand over a credit card and driver’s license until the bill is paid, according to officer manager Vanessa Castillo.

Castillo gave investigators a photo copy of Connors’ driver’s license that identified his home address as the Kissimmee Police Department.

Videos from the club’s surveillance cameras released by the Brevard-Seminole State Attorney’s Office show Connors and two friends walk out of the club shortly before the crash. Connors kicked off his sandals and began shadow boxing barefoot on the pavement.

After slipping his sandals back on, Connors dropped his keys and took a moment to retrieve them before opening the driver’s door of his truck. After sitting for about a minute, he put the pickup in gear and immediately struck the classic car parked next to him, the video shows.

The defendant struck the Oldsmobile, stopped, changed the direction of his front wheels, drove further continuing to strike, a Brevard County Sheriff’s investigator wrote after watching the video. The defendant stopped for a moment, then fled the scene.

That’s when Jessica Bruce, 27, the car’s owner and a bartender at the strip club, came out of the club and began running after Connors’ pickup which briefly stopped at an intersection before speeding away. The sheriff’s office described noticeable damage to the Cutlass’ front bumper, hood, driver’s side fender and wheel well.

Bruce could not be reached for comment.

Records state Connors was advised of his Miranda rights to remain silent and told the crash investigator he was driving. struck the vehicle that was next to him and he fled the scene.

In January, he received his agency’s employee-of-the-month award.

Connors has distinguished himself within the department by proving that he is a hardworking, strong leader and team player.     Stop and Assess the Situation

    First, stop and assess the situation. Are there any injuries or death? Investigate the extent of the damage, and call for assistance if necessary. In California, failure to stop at the scene of an accident in which you are involved could result in serious criminal hit-and-run charges.

    You must stop to assess the situation even when the accident involves merely damaging property or running into a parked car. If you hit a parked car or damage someone’s property, but are unable to locate the owner, leave a note with your name and address, as well as the name and address of the owner of the automobile you are driving, secured to the vehicle or property damaged.

    You will also be responsible for reporting the accident to the police or to the California Highway Patrol (in an unincorporated area).

    When animals are involved don’t take your responsibility any more lightly. Again, pull over. Try to find the owner. If the owner cannot be found call the Humane Society, the police, or the Highway Patrol.

    What You Will Have to Show

    • Place and time of accident.
    • Other driver’s name, address, and date of birth.
    • Other driver’s driver license information(#/State).
    • Other driver’s license plate number and state.
    • Other driver’s insurance company, policy number, and the expiration thereof.
    • Policy holder’s name and address.
    • Vehicle owner’s name and address.
    • Explanation of injuries or property damage.

    The DMV SR1 is also required regardless of whether the accident occurred on private property or was caused by someone else.

    Failure to file a necessary Report of Traffic Accident Occurring in California (Form SR-1) or failure to show proof of financial responsibility may result in the suspension of your license.

    Unless the officer finds the other driver at fault, any accident the police report to the DMV will go on your driving record.

    Removed your vehicle from the street or highway

    Don’t forget to have your vehicle removed from the street or highway. Failure to do so may result in your vehicle being towed or impounded.

    Getting a Damage Estimate

    Usually, you don’t have to get any estimates yourself. Normally, the insurance company that is paying to repair your car damage will have an on-the-road estimator go to your car and estimate the cost of repairing the car. Alternatively, if your car can be driven lawfully, some companies may ask you to drive your car to their closest estimating facility.

    Choosing the Repair Shop

    You can probably choose where you want to havfe repairs done. However, some insurance companies are writing their policies to give them the right to select the repair shop. This is something to check out when you renew your insurance policy or get a new policy — do you have the right to select the shop that will repair your vehicle?

    Obviously, if they have the right, insurance companies will send you to go to a repair shop that gives them favorable rates, in order to save the insurance company money. These deals between insurance companies and repair shops are known as DRP (Direct Referral Program) Contracts.

    Under these contracts, the insurance company refers a great deal of business to the repair facility and, in return, the repair facility gives the insurance company price breaks. This is okay if the repair facility retains control over how the vehicle will be repaired, but in some instances, those decisions are given to the insurance company. Do you want some insurance type with a calculator deciding whether to replace a car part that could affect your family’s safety?

    Your best protection is this: before your accident, purchase insurance that gives you the right to select the repair shop. Then, after your accident, select a repair shop that has a strong reputation for ethics and customer service.

    Beware of Used Parts

    The repair facility can — and probably will — fix your car with parts that aren’t necessarily new or made by the vehicle manufacturer.

    You would like the repair facility to use OEM (Original Equipment Manufacturer) replacement parts. More likely, however, they will use parts manufactured by someone other than the original equipment manufacturer, used parts or reconditioned parts. Why? They’re cheaper.

    If you are dealing with the other driver’s insurance company under the other driver’s property damage liability insurance, that company’s obligation is to put your car back into the condition it was in before their policyholder crashed into you.

    Since your vehicle had used parts before it was damaged, it is acceptable to use used parts in the repairs.

    On the other hand, non-OEM parts — sometimes called aftermarket parts — may be markedly inferior junk parts that can, in some instances, be a safety hazard. You should not accept them without a fight.

    If you are dealing with your insurance company under your collision coverage, there is probably a provision in your insurance policy that requires your company to provide parts of “like kind and quality.” To describe these parts, the shorthand “LKQ” is often used.

    Here, also, your position should be that non-OEM parts are not of LKQ. You should insist on OEM replacement parts or, at least, used OEM parts.

    If the insurance company insists on using aftermarket (non-OEM) parts, you should do one of two things. One is to pay the additional amount to get OEM replacement parts and then to sue the at-fault party in small claims court for the difference. The other is to insist that the insurance company gives you a written warranty of the aftermarket parts that lasts as long as you own the car.

    When New Damage is Discovered

    What if additional damage is found while the repair work is being done? This happens quite frequently. Once a mechanic goes under the hood or puts the car up on a lift, additional damage is discovered that couldn’t be seen before.

    When that happens, normally the repair shop contacts the insurance company and tells them what the additional damage is. The insurance company sends an appraiser to see if they agree. If they do, they authorize the work.

    If you have chosen a repair shop with a reputation for quality work and strong ethics, they will make sure that this is done and that your vehicle is repaired correctly.

    Semi Truck Repair Tips, Tricks and Advice


    For 2 years, I have changed 2 clutches. Driving the first 50,000 miles, everything seems to be fine. After that, the problem starts with a grinding noise. First, it can be detected from the start and then when heavy, but later this noise is almost all the time, no matter if heavy, light or empty. What could be the problem? I ve spend a lot of money but the problem is not resolved.

    Answer: First, what shop changed the clutch? Do you use the clutch regularly? Is there a possibility the installed clutch could be the wrong one for the truck? The clutch installed could be too light for the work the truck is doing. It should be under warranty up to one year. Before the year is up, and if you re over the 50,000 miles, the moment it starts to grind, take it back to the shop who installed it. They ought to figure it out. Of course, this shouldn t be happening for every clutch. Something is clearly wrong.



    Semi Truck Repair Question: I m having a problem with loosing radiator fluid, from my semi. It looses about a half gallon a day. The sensor was replaced and a leak was fixed at the shop, but every day I still need to add 3/4 gallon of fluid. The alarm also stays on. The truck is a 2010, with abut 230,000 miles.

    The fluid disappears while the truck is shut down. I can shut it down in the evening with no problem and when I wake up and start my pre-trip, I start the truck and low light is on and the coolant level is low, but no fluid on the ground.

    The rad fluid disappears when the truck is shut off. There is no sign of fluid on the ground.

    Answer: Check the oil when the truck is cold for signs of coolant on the dipstick. Many manufacturers set the low coolant sensor too high on the radiator. The rad has an overflow tube that could be draining the coolant to below the sensor level. This is more likely the case as your truck is relatively new.

    The coolant could also be escaping into the engine or evaporating. If there s no coolant on the ground, and it s disappearing when the truck is shut off, it s most likely a head gasket. If it s not leaking externally, it s leaking internally.

    Take the truck to the engine manufacturer, like a Cummins or Cat shop or whatever your motor is, you didn t say, NOT the truck dealer or just any dealer.

    ***IF the semi is an older model, this can be a sign of a head gasket needing attention .

    Reduced Power

    Semi Truck RepairQuestion. Has anyone had problems with their truck going to reduced power after 250 thousand kms?

    Answer. I never rely on sensors. I always check my fluids, belts and brakes, also any leaks by hand before every trip. I do not trust these new sensors in trucks. I am old school . do your walk around and keep an eye on the gauges.

    I operated a Cascadia when they first came out. I had lots of problems with the sensors. The truck was always in the shop. It s a good thing there was a good warranty on it.

    ** Electronic system may sense a problem.

    **S.T.G. Comment. Programming in new trucks is often set in order to reduce power when the electronic system senses a problem.

    The truck should be taken to a dealer right away. If the truck continues to reduce it s own power, and the dealership continually finds nothing wrong other than a faulty sensor, you may wish to consider having the programming on the sensor changed by the dealer. The dealer will just blank out the sending units.

    However, should you do this, you ll need to manually check such things as rad level and oil levels consistently.

    Release Brake Lock

    Semi Truck Repair Question. How do I release the brake lock, once the brake is locked by loosing the air from the brake chamber?

    Answer. Don t mess with this yourself. Take it to a licensed mechanic a.s.a.p. Do not fool around with brake chambers.

    Double Check

    Know your equipment. Don t always take the word of the shop mechanic as being totally right. I had a truck gel up on Rogers Pass in Montana at 1:00 am in January 1993. The mean temp was -42 F. The shop mechanic had done a repair on a cross-over line, but did not treat or cut the number 2 diesel in the tank that was shut off before the repair. When you are out in the middle of nowhere in temperatures like this, it can be very dangerous. Luck would have it someone stopped and took me into Lincoln Montana. Inspect everything on your truck and know its road ready.

    Simple Semi Truck Repair Do-It-Yourself

    • By doing things yourself, you can save thousands in labor costs. If you don t believe me, take a look at your next repair bill, parts verses labor. Cut the labour and that s money in your pocket.
    • Your rig is a large air compressor . setting it up for air tools is easy and inexpensive. Tooling up is also cheaper than the shop. Learn to do the easy stuff yourself. It s not rocket science.
    • Tires and brakes are the trucks second big expense. You can buy your tires at a good price and stock pile them at home and save money that way, plus with mount and dismount.
    • Brakes as well are cheaper by themselves than at a shop and easy to install. You can always stock your own parts.
    • Do not change your own oil unless you have a way to dispose of 11 gallons of used oil. That is way too costly trust me, I learned the hard way on that one.
    • But changing your own filters? You bet you can do that. Figure the shop is going to charge you a minimum of $60, just to change a $12 $17 filter. Save all that cash for yourself. (Dan, Clinton, UT)
