Quota fissa – 2 Ђ per confezione fino a un massimo di 4 Ђ per ricetta

Quota di Rimborso – viene aggiunta alla quota fissa e si calcola come differenza dovuta tra il prezzo di rimborso dei farmaci non coperti da brevetto ( GENERICI ) e il prezzo del medicinale di marca. Il paziente и tenuto a pagare questa quota solo se non accetta il farmaco generico e chiede al farmacista di avere il farmaco originale di marca.

TICKET sulle prestazioni diagnostiche:

Quota variabile – dipende dal tipo e dal numero di esami, di visite o di accertamenti presenti sulla richiesta compilata dal Medico e puт arrivare fino ad una spesa massima di 36,15 Ђ per ricetta

Quota fissa – viene aggiunta alla quota variabile una quota fissa di 10 Ђ per ogni ricetta.

Introdotta il 1 Gennaio 2007, dopo molte contestazioni era stata abolita dal 20 Maggio 2007 per effetto della legge n.64 pubblicata sulla Gazzetta Ufficiale del 19 maggio 2007. E’ stata nuovamente introdotta dalla legge finanziaria 2011 a decorrere dal 17 Luglio 2011 (Decreto legge 6 luglio 2011, n. 98 – pubblicato nella Gazzetta Ufficiale 6 luglio 2011, n. 155 – convertito, con modificazioni, con la legge 15 luglio 2011, n. 111 – pubblicata nella Gazzetta Ufficiale 15 luglio 2011, n. 164).

La quota massima di ticket и quindi salita a 47 Ђ per ricetta

Quota fissa – quota di 25 Ђ che viene applicata agli accessi il Pronto Soccorso considerati CODICI BIANCHI, cioи interventi non urgenti risolvibili anche dal medico di famiglia. Sono esclusi i casi in cui l’accesso al Pronto Soccorso avvenga a seguito di traumatismi o avvelenamenti acuti, o riguardanti assistiti di etа inferiore ai 14 anni.

Introdotta nel 2007 era stata largamente non applicata dalle Regioni. E’ stata nuovamente introdotta dalla legge finanziaria 2011 a decorrere dal 17 Luglio 2011 (Decreto legge 6 luglio 2011, n. 98 – pubblicato nella Gazzetta Ufficiale 6 luglio 2011, n. 155 – convertito, con modificazioni, con la legge 15 luglio 2011, n. 111 – pubblicata nella Gazzetta Ufficiale 15 luglio 2011, n. 164).

La legge finanziaria 2011, che ha introdotto i nuovi ticket sulla diagnostica, non ha apportato modifiche al regime delle esenzioni.

Le Persone che sono esentate dal pagamento dei ticket appena descritti, si possono dividere in due categorie:

Sono considerati esenti dal pagamento del ticket sui Farmaci e sulle prestazioni diagnostiche e di Pronto Soccorso le seguenti categorie:

  • Soggetti con etа inferiore a 6 anni e con reddito FAMILIARE complessivo inferiore a 36.151,98 Ђ annui (E01).
  • Soggetti con etа superiore a 65 anni e con reddito FAMILIARE complessivo inferiore a 36.151,98 Ђ annui (E01)
  • Disoccupati iscritti agli elenchi dei centri per l’impiego e loro familiari a carico, appartenenti ad un nucleo FAMILIARE con reddito complessivo inferiore a 8262,3 Ђ annui, incrementato fino a 11.362,05 Ђ in presenza del coniuge ed in ragione di ulteriori 516,46 Ђ per ogni figlio a carico (E02).
  • Titolari di assegno (ex pensioni) sociale e loro familiari a carico (E03)
  • Titolari di pensioni al minimo, di etа superiore a 60 anni e loro famialiri a carico, appartenenti ad un nucleo FAMILIARE con reddito complessivo inferiore a 8262,3 Ђ annui, incrementato fino a 11.362,05 Ђ in presenza del coniuge ed in ragione di ulteriori 516,46 Ђ per ogni figlio a carico (E04)
  • Cittadini di etа tra i sei anni e i sessantacinque anni, affetti da patologia cronica e appartenenti ad un nucleo familiare fiscale con reddito complessivo lordo inferiore a 36.151,98 euro (EPF – codice applicabile solo insieme al codice esenzione per patologia cronica)

ESENZIONE TICKET PER REDDITO – NON DEVONO RINNOVARE GLI ULTRA 65 E I MINORI SINO A 6 ANNI

a condizione di reddito invariata l’autocertificazione ha validitа illimitata. Se le condizioni di reddito non sono cambiate, i cittadini di etа superiore a 65 anni e i minori di 6 anni con esenzione E01 non dovranno presentare l’autocertificazione che attesti la propria situazione reddituale.

IN CASO DI UN BISOGNO SANITARIO CHI HA MENO DI 65 ANNI DEVE RINNOVARE LA CERTIFICAZIONE

Non si perde alcun diritto anche presentandosi dopo il 31 marzo. Se la persona ha meno di 65 anni ed ha un’esenzione E03, E04 o EPF deve recarsi presso la propria ASL per rinnovare il certificato annuale. E’ possibile rinnovare l’esenzione anche dopo il 31 marzo, non si perde alcun diritto. L’importante и rinnovare l’esenzione prima di una richiesta medica.

Se le condizioni di reddito cambiano nel corso dell’anno e non si ha piщ diritto all’esenzione occorre comunicarlo

tempestivamente alla propria ASL.

Le ASL effettuano i controlli sulla veridicitа delle autocertificazioni. In caso di falsa dichiarazione recuperano gli importi non

pagati per le prestazioni erogate e applicano le sanzioni amministrative previste dalla normativa vigente.

CODICE E01: Cittadini di etа inferiore a sei anni e superiore a sessantacinque anni, appartenenti ad un nucleo familiare

fiscale con reddito complessivo lordo inferiore a 36.151,98 euro

CODICE E02: Disoccupati e loro familiari a carico appartenenti ad un nucleo familiare fiscale con reddito complessivo

lordo inferiore a 8.263,31 euro, incrementato fino a 11.362,05 euro in presenza del coniuge ed in ragione di ulteriori

Pazienti esenti per Invaliditа, Malattia o appartenenza a particolari categorie sociali

I pazienti appartenenti a queste categorie sono in possesso di esenzioni per MALATTIA o per INVALIDITA’ riportate sul proprio libretto sanitario con un codice che viene sempre indicato dal medico sulla ricetta.

I pazienti appartenenti alle categorie sottoindicate non pagano alcun tipo di ticket per alcuna prestazione: farmaci, visite specialistiche, accertamenti diagnostici, pronto soccorso. Inoltre solo a queste tre categorie sono concessi gratuitamente anche i farmaci in fascia C.

VITTIME DEL TERRORISMO E CRIMINALITA’ (tutte le categorie)

I pazienti che hanno esenzioni per Invaliditа di vario genere (escluse le due categorie di Invaliditа di Guerra o Vittime del Terrorrismo riportate al paragrafo precedente) sono esenti dal pagamento dei ticket su farmaci (pagano, invece, la quota di rimborso), visite specialistiche, accertamenti diagnostici, pronto soccorso:

  • Invalidi per Servizio – tutte le categorie
  • Invalidi civili 100% con o senza assegno di accompagnamento
  • Ciechi bioculari e Sordomuti
  • Invalidi del lavoro 1° categoria (da 80 a 100%)
  • Invalidi del lavoro sup. 2/3 (da 67% a 79%)
  • Infortunati sul lavoro per il periodo dell’infortunio (solo per i farmaci correlati alla patologia)
  • Ex deportati campi di sterminio
  • Tossicodipendenti in terapia metadonica
  • Danneggiati da vaccinazioni obbligatorie, trasfusioni e somministrazioni di emoderivati
  • Pazienti in trattamento con analgesici oppiacei nella terapia del dolore (di cui all’art. 43, coma 3 bis, D.P.R. 309/90 relativamente alle prestazioni disciplinate dalla legge 8/2/2001 n.12)
  • Donne in Gravidanza
  • Soggetti affetti da Malattie Rare

PAZIENTI parzialmente ESENTI per PATOLOGIE CRONICHE:

I Soggetti con patologia cronica o invalidante NON pagano alcun ticket sulle prestazioni diagnostiche e di Pronto Soccorso inerenti la loro patologia, ma sono soggetti al pagamento dei ticket sui farmaci se hanno conseguito nell’anno precedente un reddito familiare complessivo superiore ai 36.151,98. Se il loro reddito nell’anno precdente и stato inferiore devono rivolgersi alla ASL per ottenere un tesserino con il codice EPF che verrа apposto dal medico prescrittore sulla ricetta a fianco del codice di malattia.

Das neue Jahr ist erst gut eine Woche alt und schon fliegt der Badmintonball wieder durch die Hallen. Diesmal war der VfB Friedrichshafen selbst Ausrichter der Süd-Ost-Deutschen Meisterschaften, die im Berufschulzentrum Friedrichshafen ausgetragen wurden.

Das Damenteam der TSG Ailingen hat in der ersten Saisonhälfte der laufenden Saison in der Handball-Bezirksliga durchwachsene Auftritte gezeigt. Erst kurz vor dem Jahreswechsel ließ die Mannschaft von Richard Darga aufhorchen und landete zwei Siege in Serie.

Die Hypo Tirol Alpen Volleys Haching haben von den 18 Punkten (Platz fünf) elf zu Hause geholt. Das heißt, dass der Spitzenreiter der Volleyball-Bundesliga gewarnt sein müsste.

Un gato con mucha sed intenta beber agua directamente del chorro que sale de un grifo de cocina y no se le ocurre otra cosa al gatito que meter la cabeza debajo del agua y lo mejor de todo es la cara que pone y que no sale corriendo y vuelve a intentarlo una y otra vez. Super gracioso!

Cosa sono i crediti

Il sistema Certificazione LEED Italia 2009 per le Nuove Costruzioni e le Ristrutturazioni, cosм come il sistema di certificazione LEED in generale, si basa sull’attribuzione di crediti che vengono riconosciuti dal Green Building Council Italia o del GBC Usa, in concomitanza con il raggiungimento di ciascuno dei requisiti caratterizzanti la sostenibilitа dell’edificio. La somma dei crediti, determina il livello di certificazione ottenuto.

I criteri valutativi contemplati dal LEED prevedono alcuni prerequisiti obbligatori, e un numero di performance ambientali non obbligatorie, suscettibili di attribuire il punteggio finale all’edificio e quindi la relativa classe di appartenenza dell’edificio.

C’и da dire che rispetto allo standard Americano, quello italiano nella prima fase sara’ flessibile, in quanto, per alcune categorie (vedi Energia e Atmosfera EA) in Italia non esistono dei corrispettivi standard di riferimento, basti pensare ai capitoli delle linee guida degli standard formulati dalla ASHRAE -www.ashrae.org – ossia la societа americana degli ingegneri per il riscaldamento, condizionamento e raffreddamento che non hanno fattibilitа applicativa per quanto riguarda ad esempio gli impianti di riscaldamento, ampiamente regolamentati dalla legge italiana. Analogo discorso per il calcolo delle trasmittanze termiche di infissi.

In ogni caso sia per lo standard Certificazione Leed Nuove Costruzioni (NC) e per quello Certificazione Leed Ristrutturazioni saranno previste 6 macro categorie ognuna, come dicevamo con dei prerequisiti obblogatori e altri facoltativi.

6 macro Categorie e relativi Crediti associati

  • Sostenibilita’ del Sito (1 prerequisito, 26 punti max)
  • Gestione efficiente di acqua (1 prerequisito, 10 punti max)
  • Energia ed ambiente (3 prerequisiti, 20 punti max)
  • Materiali e risorse (1 prerequisito, 14 punti max)
  • Qualitа dell’aria negli ambienti interni (2 prerequisiti, 15 punti max)
  • Progettazione ed innovazione (6 punti max)

Livelli di Certificazione ottenibili

La somma dei crediti ottenuti, puт portare a 4 livelli di Certificazione:

  • Certificazione base: tra 40 e 49 punti
  • Argento: tra 50 e 59 punti
  • Oro: tra 60 e 79 punti
  • Platino: oltre gli 80 punti

In altre parole, LEED Nuove Costruzioni prevede 100 punti base, piщ ulteriori 6 punti per innovazione. Guardando alla ripartizione dei crediti, consideriamo che lo standard attribuisce maggiore peso e quindi importanza al bilancio energetico ed alle emissioni in atmosfera degli edifici (35 punti base).

Anche la sostenibilitа del sito ha un peso significativo, pari a 26. In teoria, la piena rispondenza di questi due soli criteri consentirebbe di ottenere la Certificazione Leed Oro per un edificio (35+26=61), completamente prescindendo dagli altri criteri valutativi introdotti.

In pratica, sono moltissime le possibilitа di ottenere crediti LEED. Oltre ad una opportuna scelta del sito, si puт curare l’isolamento termico dell’edificio, installare impianti fotovoltaici, implementare sistemi di riscaldamento ad energia solare, scavare pozzetti geotermici, scegliere materiali con contenuto di riciclato, materiali di origine locale, materiali rinnovabili, materiali provenienti da processi di riciclo, materiali a bassa emissione di sostanze organiche, legno certificato FSC, ecc.

Deve essere coinvolto l’intero team di progettisti che lavora alla progettazione ed alla costruzione dell’immobile, per individuare e mappare tutte le soluzioni praticabili, alla luce dell’obiettivo di certificazione stabilito.

A chi mi devo rivolgere per conoscere i crediti LEED di un prodotto?

Da tempo esiste nel mercato italiano, una APP nonchи un motore di ricerca sul web, che permette di individuare facilmente tutti i prodotti che possono contribuire all’ottenimento di determinati crediti LEED.

All’interno dei crediti per i materiali e risorse, nello standard americano e presumo in quello definitivo italiano, si richiede che almeno il 50% del legno utilizzato per la costruzione, debba essere certificato FSC. Ricordo che l’FSC и un’organizzazione a livello mondiale che promuove la gestione delle foreste sostenibile.

Cabe destacar además en este punto que el cliente debe de estar informado sobre el mismo y dejar constancia por escrita sobre esta información.

  • No auxiliar a alguien que se encuentre en peligro debido a una negligencia del profesional. U, ocurrida por culpa de los profesionales del estudio de tatuajes.
  • Error al informar sobre las posibles complicaciones que pueden existir al momento de realizar un tatuaje. O las consecuencias del mismo.
  • Utilización de piercings o pendientes que no se encuentren homologados para la colocación en algunas partes concretas del cuerpo.
  • Dependiendo de las necesidades de cada artista o estudio de tatuaje, la cobertura de la póliza se puede llegar a ampliar. Sobre todo en lo que se refiere al tema de los piercings que suele ser mucho más subjetivo y problemático.

¿Qué no cubre el seguro de tatuadores?

Como en cualquier otro tipo de seguro, hay algunas cuestiones que no se encuentran dentro de la póliza, con lo cual, no es posible obtener una cobertura de las mismas.

Algunos de estos casos son por ejemplo:

  • Aplicación de técnicas experimentales con productos que no se ha realizado las pruebas alérgicas previamente.
  • Contagio de enfermedades infecciosas.
  • Incumplimiento del consentimiento firmado por el cliente.
  • Incumplimiento injustificado o voluntario de las normas legales y éticas.
  • Manipulación de productos utilizados previamente.
  • Derechos de autor o patentes.
  • Tatuar a menores de 18 años sin consentimiento expreso de sus padres.
  • Pérdida o extravío de bienes de los clientes.
  • Daños informáticos.
  • Mantenimiento de la higiene del estudio de tatuajes.
  • Ataques terroristas o fenómenos extraordinarios

¿Cómo actúa el seguro rc de tatuadores?

Existen distintas circunstancias en donde podemos llegar a necesitar hacer uso de la póliza del seguro de responsabilidad civil de tatuadores.

Garantías de responsabilidad civil profesional

Están las garantías de responsabilidad civil profesional, es decir todos aquellos daños que se causan contra terceras personas durante el desarrollo de la actividad. En estos casos, se va a realizar una reclamación por parte del cliente que puede hacerse de distintas formas por una denuncia o a través de una hoja de reclamación.

Garantías de responsabilidad civil de explotación

Otro caso es cuando se dan garantías de responsabilidad civil de explotación. En este caso nos referimos a aquellas indemnizaciones o daños que puedan aparecer de forma in voluntaria a terceros. Debido a la explotación del negocio de tatuadores.

En los casos en que se reclama una indemnización al estudio de tatuajes éste podrá responder por su seguro de responsabilidad civil.

Garantías opcionales

También existe la posibilidad de colocar garantías opcionales en lo que se refiere al seguro de responsabilidad civil. Que se deben indicar al momento de su contratación. Un ejemplo de ello es el hecho de añadir un seguro que cubra la aplicación de productos cosméticos autorizados por Sanidad o la venta de los mismos.

What are the principal types of life insurance?

There are two major types of life insurance—term and whole life. Whole life is sometimes called permanent life insurance, and it encompasses several subcategories, including traditional whole life, universal life, variable life and variable universal life. In 2003, about 6.4 million individual life insurance policies bought were term and about 7.1 million were whole life.

Life insurance products for groups are different from life insurance sold to individuals. The information below focuses on life insurance sold to individuals.

Term Insurance is the simplest form of life insurance. It pays only if death occurs during the term of the policy, which is usually from one to 30 years. Most term policies have no other benefit provisions.

There are two basic types of term life insurance policies: level term and decreasing term.

  • Level term means that the death benefit stays the same throughout the duration of the policy.
  • Decreasing term means that the death benefit drops, usually in one-year increments, over the course of the policy’s term.

In 2003, virtually all (97 percent) of the term life insurance bought was level term.

Whole life/permanent

Whole life or permanent insurance pays a death benefit whenever you die—even if you live to 100! There are three major types of whole life or permanent life insurance—traditional whole life, universal life, and variable universal life, and there are variations within each type.

In the case of traditional whole life, both the death benefit and the premium are designed to stay the same (level) throughout the life of the policy. The cost per $1,000 of benefit increases as the insured person ages, and it obviously gets very high when the insured lives to 80 and beyond. The insurance company could charge a premium that increases each year, but that would make it very hard for most people to afford life insurance at advanced ages. So the company keeps the premium level by charging a premium that, in the early years, is higher than what’s needed to pay claims, investing that money, and then using it to supplement the level premium to help pay the cost of life insurance for older people.

By law, when these “overpayments” reach a certain amount, they must be available to the policyholder as a cash value if he or she decides not to continue with the original plan. The cash value is an alternative, not an additional, benefit under the policy.

In the 1970s and 1980s, life insurance companies introduced two variations on the traditional whole life product—universal life insurance and variable universal life insurance.

Muchas personas que tienen su empresa, quieren aprender de los negocios exitosos y entender como lograrlo. En Mexico, existen varios modelos de negocios que tienen mayor oportunidad de éxito.

Desde mi punto de vista, esto puede ser alcanzable por cualquier empresa pequeña mexicana a traves de un formato de negocios innovadores. El punto donde generalmente fallan es en crear una marca y posicionar la marca en la mente del consumidor.

Por ejemplo, un mal nombre de negocio como “Tacos Ajax” puede destruir un negocio, a pesar de tener un buen producto a precio razonable.

2. Negocio de la construcción

En los últimos 20 años, hemos crecido exponencialmente, en materia de población en Mexico. Uno de los negocios exitosos ha sido toda la industria de la construcción, desde el albañil que edifica la casa, el arquitecto que la diseña, y el proveedor de la materia prima.

Hay varias alternativas de ideas de negocios exitosos potenciales para esta industria, por ejemplo, ofrecer un servicio garantizado de mano de obra en una construcción, servicios de arreglo para personas de la tercera edad, arreglo de composturas menores, venta de material ecológico, etc.

3. Educación

Otro nicho donde se cumple la formula del buen negocio (productos en demanda) es todo lo referente a la tecnología. Para los pequeños negocios exitosos, el éxito depende sin lugar a duda de la ubicación.

Practicamente en las principales ciudades de Mexico, vemos que existe algo llamado “Plaza de la computación”. Esto es una instalación donde varios negocios pequeños compiten para darle al cliente el mejor precio en X producto tecnológico.

Al final de cuentas, no es tanto el precio por donde ganan, sino la gran cantidad de prospectos que se generan, por el simple hecho de estar ahí, a diferencia de rentar un local en otra zona.

Cada año, el número de personas con acceso a internet, una tarjeta de crédito, y conocimiento del uso del internet aumenta. La generación de las redes sociales y el celular, están más cómodas comprando productos en internet, y en algunos años tendrán el poder económico para comprar en internet.

Este momento es el mejor para cualquier exportador. Teniendo el dolar en 14 pesos, listo para subir incluso más, permite que al cotizar su producto en dólares, obtenga más dinero por su producto.

En este caso, el negocio exitoso depende de que exista un mercado exterior con demanda del producto. Por ejemplo, en México, el mayor socio comercial es Estados Unidos, y se exporta una gran variedad de productos.

» Chi deve pagare le multe stradali? A chi si tolgono i punti?

Di norma il pagamento di sanzioni amministrative pecuniarie (multe) per violazioni del codice della strada sono dovute dal conducente che commette l’infrazione nel momento in cui essa viene rilevata.

In caso di impossibilita’ del conducente nel pagare la sanzione, l’obbligo ricade sul proprietario del veicolo, a meno che quest’ultimo possa dimostrare che non era a conoscenza che il veicolo veniva condotto dal presunto conducente sanzionato.

> Ulteriori sanzioni come sospensione o ritiro della patente, sono invece a carico esclusivo del conducente al momento dell’infrazione.

> Nel caso di ritiro dei punti della patente si applica..

> Nel caso di infrazioni commesse da persone capaci di intendere e volere, ma soggette a vigilanza o responsabilita’ altrui (genitori di figli minorenni etc.) sia chi commette l’infrazione che l’incaricato della vigilanza/responsabilita’ saranno soggetti IN SOLIDO al risarcimento del danno o alla sanzione amministrativa.

Il pagamento in solido significa che la sanzione dovra’ comunque essere pagata, o dall’uno o dall’altro soggetto responsabile.

Nel momento in cui uno dei soggetti paga, gli altri non hanno piu’ alcun obbligo di pagamento verso le Autorita’.

L’art. 202 del codice della strada, stabilisce che in caso di sanzione pecuniaria (multa), il trasgressore potra’ pagare entro 60 giorni dalla contestazione/notificazione della stessa, un importo pari al minimo fissato per la norma infranta. Una sanzione appunto in misura ridotta.

Non ci sono in questo caso riduzioni per eventuali sanzioni accessorie (ritiro patente, sospensione, etc).

Non e’ possibile ottenere il pagamento in forma ridotta se il conducente di veicolo a motore non ha arrestato il veicolo sotto l’ordine delle forze di Polizia, oppure si e’ rifiutato di esibire documento d’identita’, la patente, il libretto o altri documenti da detenere obbligatoriamente per la guida in quel particolare caso.

Dal codice della strada: "Il pagamento in misura ridotta non и inoltre consentito per le violazioni previste dagli articoli 83, comma 6; 88, comma 3; 97, comma 9; 100, comma 12; 113, comma 5; 114, comma 7; 116, comma 13; 124, comma 4; 136, comma 6; 168, comma 8; 176, comma 19; 216, comma 6; 217, comma 6; 218, comma 6. Per tali violazioni il verbale di contestazione и trasmesso al prefetto del luogo della commessa violazione entro dieci giorni (1)"

Di norma le multe vanno pagate tramite bonifico bancario o bollettino postale.

E’ altresi’ spesso possibile pagare la sanzione presso l’ufficio competente in contanti o bancomat, oppure in alcuni comuni presso tabaccherie/ricevitorie del Lotto convenzionate, portando con se la scheda allegata al verbale recapitato a casa.

Alcuni comuni prevedono il pagamento on line con carta di credito.

E’ comunque consigliabile visitare il sito del proprio comune e cercare informazioni a riguardo.

Fare ricorso non e’ sempre qualcosa di semplice, e non basta un modello di ricorso prestampato o una sentenza simile al proprio caso per proporre o vincere il ricorso.

Innanzitutto occorre ovviamente analizzare il verbale della contravvenzione, e controllare la eventuale presenza di vizi di forma o sostanziali.

Viele Jugendliche, das ist unumstritten, suchen mehr oder weniger intensiv nach einem Nebenjob. Denn auch junge Leute wissen bestens, dass sich eine Menge Wünsche nur mit dem nötigen Kleingeld in der Tasche verwirklichen lassen – und da zur Wunscherfüllung das Taschengeld meist nicht ausreicht, muss eben ein Nebenverdienst her.

Die Jobmöglichkeiten für Schüler jedoch sind aufgrund des Jugendschutzgesetzes relativ begrenzt und noch dazu oftmals nicht gerade üppig bezahlt. Doch auch als Jugendlicher (egal, ob man 13, 15, 16 oder 18 Jahre alt ist) möchte man sich nur ungern für Nebenjobs zur Verfügung stellen, in denen man sich durch schlechte Bezahlung regelrecht ausgebeutet fühlt.

Glücklicherweise sorgt die gute Vernetzung unter den Schülern und Jugendlichen dafür, dass sich die richtig schlechten Nebenjobs relativ schnell herumsprechen. Die Praxis zeigt: Je jünger die Jugendlichen, desto weniger Nebenjob-Möglichkeiten bieten sich an und desto geringer ist auch die Bezahlung für diese Jobs. Sono sempre più frequenti le richieste di informazioni in merito alla possibile coesistenza tra partita iva e lavoro dipendente, vale a dire la possibilità di aprire un’attività autonoma e restare allo stesso tempo dipendenti. L’aspetto più discusso riguarda la corretta qualificazione dei soggetti che avviano l’attività dal punto di vista della contribuzione previdenziale INPS.

La fattispecie che tratto in questo articolo riguarda i dipendenti di aziende private poiché nel settore pubblico esistono specifiche disposizioni circa la possibilità o meno di affiancare il lavoro dipendente con altre attività. Si veda il nostro articolo dipendente pubblico e partita iva .

Dipendente e partita iva, doppia contribuzione Inps?

Entrando nel merito della questione, si deve subito precisare che non si arriva alla stessa conclusione se l’attività è svolta in forma d’impresa oppure come lavoratore autonomo.

Il dipendente full time, versa i contributi INPS per il tramite del proprio datore di lavoro; se intende avviare un’attività in proprio diventa necessario capire che cosa ciò comporta ai fini contributivi in quanto, in prima analisi, sembrerebbe aggiungersi un onere contributivo rispetto a quello già presente come lavoratore dipendente.

La risposta a questa problematica è la seguente:

se il lavoratore dipendente avvia un’attività d’impresa commerciale egli, avendo già un lavoro che si possa qualificare come prevalente sia in termini di tempo che in termini reddituali (reddito annuo come lavoratore dipendente maggiore del reddito derivante dall’attività commerciale), non dovrà essere iscritto alla gestione commercianti dell’INPS e quindi non dovrà versare ulteriori contributi (nemmeno il minimale previsto) rispetto a quelli che già versa come dipendente;

se invece l’attività che viene avviata è di lavoro autonomo (libero professionista), il lavoratore dovrà necessariamente iscriversi alla gestione separata INPS versando il contributo con aliquota ridotta.

Nel primo caso, se ricevi una comunicazione di iscrizione dallINPS ti consiglio di recarti presso lente con le ultime buste paga. Puoi così provare l’esistenza del rapporto di lavoro dipendente.

In conclusione vale la pena precisare che non si incontrano evidenti difficoltà qualora il contratto di lavoro dipendente sia a tempo pieno e con durata indeterminata. Se, al contrario, il contratto di lavoro è a tempo determinato (ad esempio per pochi mesi), lesonero contributivo si può richiedere solo per quel periodo.

non ci sono riferimenti normativi precisi, è linps a valutare lesonero o meno sulla base di due fattori: tempo impiegato e reddito percepito.

Se da dipendente risulta essere la primaria sia dal punto di vista dei redditi, sia dal punto di vista del tempo impiegato, può richiedere lesonero dal versamento dei contributi inps.

Questa è una valutazione che spetta allinps.

Le consiglio comunque di recarsi allo sportello inps della sua città, con le ultime buste paga e cud e farne richiesta.

Potrebbe ottenere lesonero per ciò che riguarda la sua posizione, mentre il coniuge se non ha redditi da dipendenti è tenuto al versamento dei contributi inps per intero.

El timo del Banco Sabadell a sus hipotecados: cambiar la cláusula suelo por un interés fijo

Banco Sabadell es ya prácticamente la única entidad que sigue defendiendo la legalidad de las cláusulas suelo hipotecarias y que se resiste a cumplir las sentencias de los tribunales. La última estrategia de la entidad que preside Josep Oliú ante la avalancha de clientes que exigen la retirada de estas cláusulas en sus hipotecas es cambiarles el tipo variable por uno fijo, para que sigan pagando de más. Todo ello sin abonar una indemnización por las cantidades indebidamente cobradas hasta la fecha y obligando a los clientes a renunciar a reclamaciones por la vía judicial.

Así lo han denunciado varios afectados a OKDIARIO, que ha podido comprobar la veracidad de los hechos en la denuncias llegadas a la Asociación para la Defensa de Consumidores y Usuarios de Bancos, Cajas y Seguros (Adicae). El mecanismo es el siguiente: una vez que el cliente afectado se dirige a su oficina para exigir la retirada de la cláusula, el banco recomienda cambiar el tipo de interés al que se referencia la hipoteca (el Euribor) por un tipo fijo, argumentando que ello beneficia al afectado, porque se cubre ante subidas del precio del dinero a corto plazo.

“El Sabadell atemoriza a los afectados con una seguras e inminentes subidas del Euribor a pesar de que el presidente de la entidad asegura públicamente que no espera un cambio de tendencia en los tipos de interés en el corto plazo, vendiéndoles que se trata de un favor cuando se trata de un timo y un abuso a todas luces”, explican desde Adicae.

Pongamos un caso concreto llegado a las oficinas de esta organización de consumidores. Un cliente del Sabadell que contrató la hipoteca al 0,75% de diferencial más Euribor que hoy revise su hipoteca debería abonar un 0,737% (Euribor al -0,012). “Pero al tener cláusula suelo, fijada al 2,5%, está pagando un 1,76% más de lo que le corresponde y ahora el Sabadell le propone cambiar el actual y fraudulento 2,5% a interés variable por un 2,15% a tipo fijo, donde el suelo desaparece a cambio de seguir pagando un 1,41% más de lo que firmó”, indica Adicae.

No es la única estratagema que están realizando los empleados del Banco Sabadell a las ordenes de Oliú. La otra vía de intentar eludir su responsabilidad con sus clientes es retirarles la citada cláusula a cambio de firmar un pacto de silencio que obliga al cliente a no decirle nada a su abogado ni a nadie más, incluidos medios de comunicación, tal como avanzó OKDIARIO. El acuerdo contempla, como en el caso anterior, la renuncia a la indemnización correspondiente a cambio de no iniciar un proceso judicial o retirarse del que tenga en marcha.

Cobrar al cliente por entregar justificantes de pago de cuotas

Algunos de los afectados consultados por este diario confirman este hecho y denuncian que la entidad “pone muchas trabas para obtener los papeles necesarios para iniciar una acción judicial”, tales como los justificantes de los pagos de las cuotas hipotecarias y los intereses abonados. “En algunos casos incluso se cobra al cliente por facilitarle los recibos”, explica un letrado de un importante bufete.

Las fuentes del Banco Sabadell consultadas señalan que las cláusulas suelo y los compromisos de confidencialidad “forman parte de un acuerdo privado y legal entre la entidad y el cliente”, por lo que no consideran que exista algo irregular en ellas.

Los despachos de abogados consultados por este diario, especializados en la defensa de afectados por abusos del sector financiero, recomiendan no aceptar este tipo de ofertas y reclamar la retirada de la cláusula suelo, así como la devolución de las cantidades cobradas de forma indebida al menos desde mayo de 2013, que es la fecha que ha estipulado el Tribunal Supremo para la retroactividad. En estos momentos el Tribunal de Justicia de la UE debate declarar la retroactividad total, lo que obligaría a las entidades a aumentar sus provisiones para cubrir las devoluciones, que pueden demorarse hasta 2017.

Desde las entidades financieras se intenta trasladar la idea de que la citada retroactividad total generaría un agujero de 20.000 millones de euros en sus balances, aunque otros cálculos, como los realizados por Analistas Financieras Internacionales (AFI) rebajan la cifra hasta los 10.000 millones de euros.

Cláusulas ilegales y abusivas, según el Tribunal Supremo

La ilegalidad de las cláusulas suelo se basa en que adolecen de “falta de transparencia”, de acuerdo con la doctrina del Tribunal Supremo, ya que “no superan el control de inclusión de las condiciones generales de contratación”. En concreto, “se crea la apariencia de un contrato de préstamo de interés variable en el que las oscilaciones a la baja del Euribor repercutirían en una disminución del precio del dinero, cuando, por aplicación de la cláusula suelo, se convierte en un préstamo a interés mínimo fijo”.

Además, para el Supremo, estas cláusulas “son abusivas por su falta de reciprocidad y por el desequilibrio que introduce en el reparto de riesgos” entre el cliente y el banco, tal como señala el Supremo. Como consecuencia de ello, la entidad “percibe cantidades por encima del interés variable previsto en la escritura de préstamo”.

Tort system: Indiana is not a no-fault insurance state. Indiana is a tort state. When an accident occurs, someone must be found to be at fault, and that person and their car insurance company are responsible for the damages they caused, up to the limits of that person’s car insurance policy.

Cancellation and nonrenewal restrictions: Your Indiana auto insurance company may cancel a new policy within the first 60 days for any reason. After 60 days, your insurer may only cancel for certain approved reasons, such as nonpayment of premium or losing your driving privileges. If your auto insurer is not going to renew your policy, it must give you 20 days’ advance notice.

Verification of minimum liability insurance: The Bureau of Motor Vehicles (BMV) is required to verify that you have the minimum liability insurance coverage in effect whenever you’re involved in:

  • A car accident for which the BMV receives an accident report.
  • A moving violation that carries license points within one year of receiving two other moving violations that carry points.
  • A serious traffic violation, such as a misdemeanor or felony.

Zweigniederlassung ausländischer Unternehmen – FAQs

1. Was ist eine Zweigniederlassung?

Der Begriff der Zweigniederlassung ist gesetzlich näher definiert. Als Zweigniederlassung wird ein vom Hauptsitz räumlich getrennter, organisatorisch weitgehend verselbständigter Teil eines Gesamtunternehmens verstanden, wobei dieser unter einer eigenen Leitung tätig wird und auf mehr als nur vorübergehende Dauer hin angelegt ist. Zweigniederlassungen, die innerhalb Österreichs errichtet werden, sind verpflichtend zum Firmenbuch anzumelden. Sie verfügen aber dennoch über keine eigene Rechtspersönlichkeit. Rechtsträger bleibt vielmehr jene natürliche oder juristische Person, die auch hinter der Hauptniederlassung steht.

Bei dem dahinterstehenden Rechtsträger kann es sich auch um solche juristischen oder natürlichen Personen handeln, die ihren Sitz bzw. gewöhnlichen Aufenthalt außerhalb Österreichs haben.

2. Welche Vorteile hat die Zweigniederlassung?

Die Errichtung einer Zweigniederlassung ermöglicht es ausländischen Rechtsträgern, in Österreich eine Gewerbeberechtigung zu lösen und anschließend in stabiler und kontinuierlicher Weise am heimischen Wirtschaftsleben teilzunehmen. Zwar könnte dieses Ziel auch durch Errichtung einer österreichischen Tochtergesellschaft, typischerweise einer Gesellschaft mit beschränkter Haftung (GmbH), erreicht werden. In vielen Fällen erweist sich die Errichtung einer Zweigniederlassung jedoch als kostengünstiger und generell unkomplizierter: Dies etwa, weil bei einer Zweigniederlassung kein Mindeststammkapital aufgebracht werden muss. Ebenso ist die Errichtung der Zweigniederlassung, anders als die Gründung einer GmbH, nicht zwangsläufig an die Mitwirkung eines Notars geknüpft. Überhaupt entfallen bei der Zweigniederlassung viele formelle Abläufe, die im GmbH-Recht zwingend vorgeschrieben sind (z.B. Protokollierung von Beschlüssen). Ungeachtet der weiterhin bestehenden steuerlichen Buchführungspflichten, müssen keine eigenen Bilanzen für die Zweigniederlassung erstellt, sondern höchstens solche des dahinterstehenden Rechtsträgers im Firmenbuch veröffentlicht werden. Außerdem ist die Löschung einer Zweigniederlassung regelmäßig einfacher als die Liquidation einer GmbH.

3. Welche ausländischen Unternehmer können Zweigniederlassungen errichten?

Grundsätzlich können alle ausländischen Unternehmer eine Zweigniederlassung gründen, solange sie in ihrem Heimatstaat im Firmenbuch bzw. einem vergleichbaren Register protokolliert sind. Theoretisch können also auch eingetragene ausländische Einzelunternehmer eine Zweigniederlassung errichten, wenngleich es in der Praxis zumeist (größere) Gesellschaften sind, die grenzüberschreitend expandieren. Dass eine bestimmte ausländische Gesellschaftsform im österreichischen Recht vorkommt, ist keine Eintragungsvoraussetzung, sodass beispielsweise deutsche Unternehmergesellschaften (UG) oder englische Limited Companies (Ltd.) durchaus eine Zweigniederlassung in Österreich etablieren können.

4. Wie laufen Errichtung und Anmeldung der Zweigniederlassung ab?

Für das Eintragungsverfahren ins Firmenbuch ist jenes Gericht zuständig, in dessen Sprengel die Zweigniederlassung errichtet werden soll. In Wien wäre dies das Handelsgericht, in den Bundesländern die jeweiligen Landesgerichte.

Eine Zweigniederlassung kann erst nach ihrer tatsächlichen Errichtung beim Firmenbuchgericht angemeldet werden. Das bedeutet, dass die wesentlichen räumlichen und organisatorischen Voraussetzungen für den bevorstehenden Betrieb bereits geschaffen wurden. Anschließend haben der Unternehmensinhaber bzw. die vertretungsbefugten Organe einer juristischen Person die Eintragung beim Firmenbuch zu beantragen. Der Antrag muss an das für die Zweigniederlassung örtlich zuständige Gericht gestellt werden und den Antragsteller ebenso klar erkennen lassen wie das Antragsbegehr. Die Unterschrift ist gerichtlich oder notariell zu beglaubigen.

5. Welche Unterlagen sind dem Antrag ans Firmenbuchgericht beizulegen?

Nach der überwiegenden Firmenbuchpraxis wird im Zuge einer Anmeldung zumindest die Vorlage der nachfolgenden Dokumente erwartet:

  • Nachweis über den rechtlichen Bestand des Unternehmens im Heimatstaat (Firmenbuchauszug, Handelsregisterauszug oder vergleichbares Zeugnis der zuständigen ausländischen Behörde in beglaubigter Übersetzung),
  • Nachweis der regelmäßigen Geschäftstätigkeit im Heimatstaat (bei nicht EU-Unternehmen),
  • Beschluss über die Errichtung der Zweigniederlassung (oder entsprechende Erklärung im Zuge der Anmeldung),
  • Gesellschaftsvertrag bzw. Satzung, beglaubigt und durch Gerichtsdolmetsch übersetzt (bei Personen- oder Kapitalgesellschaften),
  • Bescheinigung über die tatsächlich durchgeführte Errichtung der Zweigniederlassung (z.B. durch Vorlage des Mietvertrags oder durch Besichtigung und anschließende Bestätigung seitens der zuständigen Wirtschaftskammerorganisation),
  • beglaubigte Musterzeichnungen der vertretungsbefugten Organe und allenfalls des ständigen Vertreters der Niederlassung,
  • evtl. Unbedenklichkeitsbescheinigung des Finanzamtes.

Zudem ist eine Firma zu wählen und im Antrag bekannt zu geben. Die Firma der Zweigniederlassung hat jenen des ausländischen Rechtsträgers im Wesentlichen zu enthalten. Ein Zusatz, der auf die Eigenschaft als Zweigniederlassung hinweist, darf geführt werden (z.B. „Niederlassung Wien“). Die immer noch verbreitete Praxis mancher Firmenbuchgerichte, wonach ein solcher Zusatz überhaupt verpflichtend sei, wurde in jüngerer Zeit teilweise zwar liberaler gehandhabt. Um dem Geschäftsverkehr gegenüber Klarheit hinsichtlich der Unternehmensverhältnisse zu schaffen, empfiehlt sich die Führung eines Zusatzes. Die Firma darf schon aus firmenrechtlichen Gründen nicht zu Verwechslungen mit anderen Unternehmen in demselben politischen Bezirk führen. Selbst die erfolgreiche Eintragung einer Firma schützt allerdings nicht vor wettbewerbs- und markenrechtlichen Problemen, wie sie immer wieder auftreten, wenn ein Unternehmer einen neuen ausländischen Markt betritt.

Bei Zweigniederlassungen von Unternehmen mit satzungsmäßigem Sitz, Hauptverwaltung oder Hauptniederlassung in einem EU bzw. EWR-Vertragsstaat ist die Bestellung eines ständigen Vertreters mit gewöhnlichem Aufenthalt in Österreich nicht erforderlich. Ansonsten bedarf es eines solchen, wobei besagter ständiger Vertreter sodann rechtliche Erklärungen in Hinblick auf die Zweigniederlassung abgeben können muss.

6. Welche Kosten fallen bei der Registrierung an?

Abgesehen von den Kosten einer eventuellen Rechtsvertretung (Notar, Rechtsanwalt) und der Beglaubigung von Unterschriften fallen bei der Eintragung einer Zweigniederlassung in das Firmenbuch außerdem Gerichtsgebühren an. Die gebührenrechtliche Praxis ist in Österreich nicht immer einheitlich. Jedenfalls sind Gebühren von je 8,40 Euro für die Eintragung von Firma, Sitz und Geschäftsanschrift der Niederlassung zu bezahlen. Hinzu kommen allgemeine Eingabegebühren, die von der Art des antragstellenden Rechtsträgers abhängig sind (zumeist zwischen 17 Euro und 145 Euro) sowie ähnlich hohe Kosten aufgrund verpflichtender Veröffentlichungen in der Wiener Zeitung. Je nach Anzahl der einzutragenden Tatsachen können weitere Posten hinzutreten, die vom Firmenbuchgericht ermittelt und dem Antragsteller anschließend vorgeschrieben werden.

7. Braucht die Zweigniederlassung eine Gewerbeberechtigung?

Übt die Zweigniederlassung eine gewerbliche Tätigkeit aus, so benötigt sie eine bei der Gewerbebehörde (in Wien Magistratisches Bezirksamt, sonst Magistrat bzw. Bezirkshauptmannschaft) angemeldete Gewerbeberechtigung. Um eine solche zu erlangen, hat sie einen gewerberechtlichen Geschäftsführer namhaft zu machen. Dieser muss die Voraussetzungen der Gewerbeausübung nach österreichischem Recht erfüllen und überdies in der Lage sein, sich im Betrieb in einer Weise zu betätigen, durch die er die Einhaltung gewerberechtlicher Auflagen gewährleistet kann. Dementsprechend muss bei reglementierten Gewerben ein entsprechender Befähigungsnachweis erbracht werden. Gewerberechtlicher Geschäftsführer ist regelmäßig ein Mitarbeiter mit hinreichendem Beschäftigungsausmaß, kann im Einzelfall aber auch vertretungsbefugtes Organ jenes Rechtsträgers sein, der hinter der Zweigniederlassung steht. Überdies muss er seinen Wohnsitz im österreichischen Inland oder – im Fall der Zweigniederlassung eines EWR-Staatsbürgers – zumindest in einem EWR-Staat haben.

Nach der Gewerbeordnung sind Gewerbetreibende verpflichtet, ihre (weitere) Betriebsstätte mit einer äußeren Geschäftsbezeichnung zu versehen. Diese hat den Namen des Gewerbetreibenden bzw. die Firma des Rechtsträgers und einen Hinweis auf den Gegenstand des Unternehmens zu enthalten.

8. Hat die Zweigniederlassung Steuern zu bezahlen?

Grundsätzlich begründet die Zweigniederlassung eine Steuerpflicht in Österreich. Um eine mehrfache Gewinnbesteuerung am Sitz der Hauptniederlassung und am Sitz der Zweigniederlassung zu vermeiden, hat Österreich mit vielen Staaten „Doppelbesteuerungsabkommen“ abgeschlossen.

9. Kann eine Zweigniederlassung geklagt werden?

Obwohl die Zweigniederlassung keine (von der Hauptniederlassung unabhängige) Rechtspersönlichkeit besitzt, kann der dazugehörige Rechtsträger am Standort der Zweigniederlassung dennoch geklagt werden, sofern der Klageanspruch in einem wirtschaftlichen Zusammenhang mit dem Geschäftsbetrieb der Zweigniederlassung steht.
