What is a Rebuilt Car Title?

Usually, to get a rebuilt car title. a car has gone through some event that caused extensive damage, and has been rebuilt to a drivable state. A rebuilt title, also known as a salvage title or reconstructed title, is used to inform the consumer of a vehicle s history. Rules may vary from state to state, but once a car has been titled as salvage, it will appear in a history report as such; even if the car is titled in different states. A rebuilt title significantly reduces the value of a used car, and there are two primary ways a car can be given a salvage title.

Insurance Total Loss

An Insurance total loss can cover accidents, natural disasters and theft. This occurs when the insurance company deems that the repairs to the vehicle are not economically practical. For instance, if the blue book value of a vehicle is $12,000, and the repair estimates are $10,500, the insurance company may pay the claimant blue book value rather than having the car repaired. In matters of theft, a salvage title may be issued for a vehicle that is recovered after a claim has been paid, even though damage may be minimal.

Impounded and Seized Vehicles

Sometimes seized, impounded or unclaimed vehicles may be given a salvage title in order to be sold to junk yards, repair shops or auction houses. In these cases vehicle damage, unpaid repairs or storage fees may exceed the value of the car. The vehicles are sold as salvage to recoup some of the costs. Titling the car salvage significantly reduces the price of the car.

Buying a car with a rebuilt title should be considered carefully. Some states require minimal inspections to declare a rebuilt car road-worthy, while others are more thorough. Check with the local Department of Motor Vehicles (DMV) for questions regarding these inspections. Do you really have to “talk to the manager”?

We call it “desking it”we’re taking the customer’s offer to the manager’s desk. I would say 90 percent of the sales force at every dealership has to do this. It’s the manager’s job to help structure the deals to earn the most profit for the dealership, or to move stagnant inventory quickly.

There’s a psychology behind the dealer’s desking practice. You see, sales people are very hungry. If they knew the bare-bones, bottom-line price that the manager could sell a car for and still make a commission, they would expedite the sale and say to the customer, “Okay, I know your budget is $35,000. Well, my bottom line is $32,000, so I’ll just sell it to you for that and everyone will be happy.” That situation would be incredibly bad for the profitability of the dealership.

Often times, we’d get enticed by bonuses tied to number of cars sold. My boss could say, “After you sell 20 cars, you’ll get a $4000 bonus.” Well if I’m at car 19, and I’m within $500 of closing my 20th dealI’d be willing to eat that $500 myself, sell the customer his car and get that juicy bonus. So that’s why we have to talk to the manager every time.

How much profit is in each car?

On certain cars there’s a vast gap between dealer invoice and MSRP. A $100,000 car could have $7000 of profit. On many lower-priced cars, that gap is very smalllike $400. Buyers can look up all this information on the Internet these days, so we never hesitate to show the dealer invoice to the customer.

You have a much different buyer than you did 20 years ago. The Internet has really made buyers experts on the cars they want to buy. They can investigate every detail about their cars, the dealership, the buying experienceeverything. And there’s a larger portion of the buyers today than ever before that actually know more about the car than the salesman does.

Still, many times it doesn’t seem to be about the actual sale price of the carit’s about the buyer’s perception of the deal. If they feel like they are catching a break, they leave happy.

What’s the best way to get a good deal?

Don’t bother dangling that “all cash” offer to a salesman. He doesn’t care. We make less money on cash deals. We make more money on the financing and get the money from the bank within the same time-frame.

But no matter what the deal looks like, it’s the hardcore hagglers that get the best prices. There are definitely those “grinders” that come into the storepeople who will keep you in the process, chiseling the price of the car down and asking you to throw in some perks on top of it. These buyers are successful. But I’ve seen some customers win by being the nice guy. They let you know how much they can afford, and you actually want to work with them.

The best deals are really situational. Perhaps a great negotiator is working to buy a car that the dealership can afford to let go at a substantially reduced price. And that’s up to the manager looking over his inventory and seeing which cars have been sitting. If I’m him, I’d much rather turn that car’s spot three times in one month than to have one car sitting. The larger dealers move a ton of inventory each month, so they can afford to sell a few cars at “Back of Book,” or $100 to $200 under invoice. Outrageous deals, like thousands under invoice, are very rare but can happen. Sometimes the manufacturer will have bonuses tied to sales. If the dealer earns a bonus for selling 200 cars, and you happen to be the 199th customer, you might get a really good deal.

The salesman won’t necessarily know which cars on the lot are those golden deals. However, the less picky a consumer is, the better. Let’s say there’s a sedan in a particularly unpopular color combination. It could have been sitting on the lot for a very long time and the dealer might be very willing to sell it to you at a lower price than the same car painted in a desirable silver or black.

When is the best time to buy a car?

I’d say toward the end of every month you might be able to get a better deal. That’s because a salesmen could be closer to hitting a particular sales threshold and might be more motivated to work for your deal. You see, sales people earn their commission based on the percentage of the profit of a car sale. But your commission increases when you sell more cars.

At my dealership, you started at 22 percent for the first eight cars you sold. Then cars nine and 10 were 24 percent. And it went all the way up to a peak of 30 percent plus an additional $300 per car if you sold a total of 17 cars in that month. So if your salesman is on car 16, he’s really going to nudge the manager to accept your deal. I can tell you that no salesman will take a day off at the end of the month. They are trying to close deals and hit those numbers. (Editor’s note: We’ve also heard that the end of the year can be a smart time to buy as well because the dealers need to get rid of leftover cars before the new models arrive.)

What’s the craziest sales situation you ever experienced?

Right before I left the dealership, another salesman sold a car to a guy who was using a false identity. It was a Friday evening. We sold the luxury car in question, and the guy actually got the car off the lot because no finance offices were open. We couldn’t verify him 100 percent. And that’s common. Typically we’ll close up deals like that on a Monday morning. That Monday we found out he was using someone else’s identity and that we’d given a $50,000 car to a thief. Even with all the documentation and information you need to buy a car these days, he still pulled it off. It was incredible.

Have you ever seriously gouged a customer?

I’m sure it happens. But I can’t say I actually saw anyone at my dealership do anything unscrupulous. The good news for the consumer is that it’s become a lot more difficult for any dealer or individual salesperson to pull a fast one on you. These days, with the JD Power customer reviews, the salesperson could be in very hot water [for not treating] customers well. On those surveys, any answer but a perfect “10” is considered a fail. So if the salesperson gets a bad review it means less money for the dealership, and less money in his own pocket. One dealership I know employed a salesman earning something like $400,000 a year. He was a very successful guy. They let him go because his survey scores were bad. So these surveys and websites like Yelp will quickly expose anyone with shady business practices.

Are those add-ons pure profit for the dealer?

At our store, the finance manager was supposed to make an additional $1000 per deal above and beyond what you negotiate the car for. Now, that could include selling the customer LoJack, an extended warranty or even window tint. As a customer, you just have to say “No” to a lot of those extras.

Or that extra cash could come through financing. Let’s say the customer’s credit is questionable, and the bank agrees to do the salesman a favor and finance the customer for 5 percent. The finance guy could tell the customer the best rate he can get is 6 percent. And so the dealership earns that extra 1 percent on the loan. So yeah, there’s definitely money made in the finance office.

Do you treat customers differently based on appearance?

Don’t judge a book by its cover. I’ve heard so many stories from salespeople about potential customers they ignored because they were dressed extremely raggedyand another salesperson eventually talked to the client and got the sale.

I know one salesman in Arizona who said he once saw a guy stroll into his store in shredded jean shorts and straggly hair and sunglasses, looking like a punk. My buddy ignored him. Well, it ended up that punk was rocker Alice Cooper and he bought six cars. These days, you can’t tell who has money and who doesn’t.

How Much Is My Car Worth?

There are a few reasons why you may ask, “How much is my car worth?” You could be selling your car or it could have been totaled in an accident. Maybe you are self employed and need to know the value for accounting purposes. When asking this question, the reason you ask is just as important as the answer.

If you are looking to sell your car, you must consider who the car is being sold to. If you car is being sold to a used car dealer, traded in on another purchase or sold to a private party will make the difference in what your car is worth to those individuals. You should also understand that you will not know the exact value of your car until you actually settle on a deal. You can only find an estimate from which to begin negotiations.

There are several Internet resources that will help you find out how much your car is worth. Going online is usually the easiest way to gather this kind of information. The following sites offer respected valuation services for free. Select “Used Car Prices” from the home pages of these sites.

  • Kelley Blue Book (KBB)
  • NADA Guides (NADA)
  • Edmunds

Before pricing your vehicle at any of these websites, there is some information you will want to have on hand. These include:

  • Your Zip Code
  • Body Style
  • Year
  • Make
  • Model
  • Trim Package
  • Engine Size
  • Options
  • Mileage
  • Vehicle Condition


Each service has its own way of looking at the condition of your vehicle. KBB offers four condition classifications and Edmunds has five. NADA does not ask you for the condition of your car. It only offers three types of trade-in values. NADA does not offer a private-party selling value.


KBB gives you the options of excellent (like new), good (minor blemishes), fair (needs a little work), poor (major problems). The site will not value cars in poor condition because prices can vary wildly on such cars. If you are unsure how to classify the condition of your car, the website offers a condition quiz to help you. It is the most user-friendly of the sites.

Edmunds Used Car Appraiser

Edmunds, one of the newer vehicle valuation sites on the Web, offers condition classifications of outstanding (perfect in and out), clean (minor, normal wear), average (few mechanical or cosmetic problems), rough (several repairs needed), and damaged (major mechanical problems and body damage).  The vehicle appraiser is more visually based that KBB, offering images of the car you are researching during the valuation process.

Each of these valuation services will give you very different trade-in numbers on the same vehicle. For instance, a 1999 Mercury Mystique with 90,000 miles in New England can have a trade in value ranging from $900 to $2,000, depending on which site you use to value your car.

You should also understand that seasonal and economic factors influence demand and therefore car prices. For example, a convertible is more valuable in the summer. In the current economic climate, it is nearly impossible to find a GMC pickup for book value. The demand is high and the market scarce for some used vehicles.

Trading It In

Once you have done some basic research, call the dealer and start at the highest price for trade in and negotiate a deal. Make sure you keep a list of all the positive points about your car as ammunition for this discussion.

You should also understand that you can try to sell the car for trade-in value to another dealer. You do not have to use the dealer where you are buying another car. You can simply sell the car to another dealer before buying from the other one.

Selling Privately

Look up your car’s value on KBB and Edmunds. NADA’s values are not very effective for private sales because they only classify vehicle conditions for trade-ins. Looking on KBB and Edmunds, the same Mercury Mystique we looked at for trade-in value has a much higher private party value. The range for private party sales was $1,730 to $1,843. This gives you a much better idea of how much you could get for your car on the private market.

If there is a large gap between the private party values, it is a good idea to peruse AutoTrader and Ebay Motors to find similar cars for sale. This will give you a better idea of the best valuation on your car before you place an ad or park the car out front with a sign on it.

Total Loss

If your car is a total loss, you will need to understand the value of your car so you can negotiate a settlement with your insurance company. Use the same method you used for the private party sale value but understand you will have to do some negotiating.

In most cases, the insurance adjuster offers the lowest reasonable value for the car and it is up to you to talk the adjuster up, based on the condition of your vehicle. The adjuster does not use KBB, NADA or Edmunds. Most insurance companies have private companies that perform valuation services for them. This is the main reason for discrepancies between the insurance company’s opinion of value and yours.

When negotiating a settlement, understand that some value arguments will only increase the salvage value of your car. This would actually detract from the final settlement check. For instance, if the tires were brand new, they do not increase the overall value of the car because tires are only a maintenance item. However, tires do increase the salvage value, which the insurer deducts from the total settlement amount.

The things that can increase your settlement value are vehicle options the adjuster did not include in the valuation. This can include items like leather seats, sunroof, spoilers and stereo equipment. Find any documentation you may have to prove you had these additional options and send them to the adjuster as proof. This will make negotiating and settling on a final value easier.

In 1908 Henry Ford began production of the Model T automobile. Based on his original Model A design first manufactured in 1903, the Model T took five years to develop. Its creation inaugurated what we know today as the mass production assembly line. This revolutionary idea was based on the concept of simply assembling interchangeable component parts. Prior to this time, coaches and buggies had been hand-built in small numbers by specialized craftspeople who rarely duplicated any particular unit. Ford s innovative design reduced the number of parts needed as well as the number of skilled fitters who had always formed the bulk of the assembly operation, giving Ford a tremendous advantage over his competition.

Ford s first venture into automobile assembly with the Model A involved setting up assembly stands on which the whole vehicle was built, usually by a single assembler who fit an entire section of the car together in one place. This person performed the same activity over and over at his stationary assembly stand. To provide for more efficiency, Ford had parts delivered as needed to each work station. In this way each assembly fitter took about 8.5 hours to complete his assembly task. By the time the Model T was being developed Ford had decided to use multiple assembly stands with assemblers moving from stand to stand, each performing a specific function. This process reduced the assembly time for each fitter from 8.5 hours to a mere 2.5 minutes by rendering each worker completely familiar with a specific task.

Ford soon recognized that walking from stand to stand wasted time and created jam-ups in the production process as faster workers overtook slower ones. In Detroit in 1913, he solved this problem by introducing the first moving assembly line, a conveyor that moved the vehicle past a stationary assembler. By eliminating the need for workers to move between stations, Ford cut the assembly task for each worker from 2.5 minutes to just under 2 minutes; the moving assembly conveyor could now pace the stationary worker. The first conveyor line consisted of metal strips to which the vehicle s wheels were attached. The metal strips were attached to a belt that rolled the length of the factory and then, beneath the floor, returned to the beginning area. This reduction in the amount of human effort required to assemble an automobile caught the attention of automobile assemblers throughout the world. Ford s mass production drove the automobile industry for nearly five decades and was eventually adopted by almost every other industrial manufacturer. Although technological advancements have enabled many improvements to modern day automobile assembly operations, the basic concept of stationary workers installing parts on a vehicle as it passes their work stations has not changed drastically over the years.

Raw Materials

Although the bulk of an automobile is virgin steel, petroleum-based products (plastics and vinyls) have come to represent an increasingly large percentage of automotive components. The light-weight materials derived from petroleum have helped to lighten some models by as much as thirty percent. As the price of fossil fuels continues to rise, the preference for lighter, more fuel efficient vehicles will become more pronounced.


Introducing a new model of automobile generally takes three to five years from inception to assembly. Ideas for new models are developed to respond to unmet pubic needs and preferences. Trying to predict what the public will want to drive in five years is no small feat, yet automobile companies have successfully designed automobiles that fit public tastes. With the help of computer-aided design equipment, designers develop basic concept drawings that help them visualize the proposed vehicle s appearance. Based on this simulation, they then construct clay models that can be studied by styling experts familiar with what the public is likely to accept. Aerodynamic engineers also review the models, studying air-flow parameters and doing feasibility studies on crash tests. Only after all models have been reviewed and accepted are tool designers permitted to begin building the tools that will manufacture the component parts of the new model.

Jap Cars are more reliable, have higher spec’s, well looked after and have a lot of life in them (low miles)

Well if you were thinking about importing a vehicle then wait and read this guide which includes hiden dangers of importing a vehicle.

Did you know you must pay TAX VAT when a vehicle arrives in the uk from Japan first you need to pay 17.5% of the cars price you purchased it for, then you must pay a varied fee of around 12% Tax of the price of the vehicle + you have to add the 17.5% VAT on to the cars value and then work out 12% of that. Crazy isn’t it.

If your car is under 10 years old you must get it SVA’d which is normal to test if the car is road worthy, HOWEVER if you import a rare car, for example a one off then you need to pay to creat a report for the car before it is SVA’d which i got a quote for a 2005 Mazda RX-8 report for 3000 from customs and exiles.

Overview and Contact Information

Peter Avagliano is a theatrical scenic and lighting designer from New Jersey. He built the first Greased Lightning car in 1984 and rented it out to local theaters that same year. Since then, he has acquired two other cars. This small fleet of cars have been the stars of over 900 productions of Grease.

Of the three models to choose from (more information on specific cars can be found below) there are two electirc models and one push-on, built to accomodate smaller performace spaces.

Free delivery is offered within fifty miles of Atlantic City, NJ. Out of area delivery can be accomodated with an extra charge.

Greased Lightning I

Originaly constructed in 1987, this car has been seen in over 600 productions of Grease. It has recently gone through a total overhaul, which included having the original golf cart chassis replaced with an all-steel constructed parade float chassis and drive system. This vehicle is now state-of-the-art on the inside, while remaining exactly what Greased Lightning is meant to be on the outside: “A kid’s first car where the first thing he does is put fuzzy dice on the mirror and dream about what it could be someday.”

As it turned out, it was rare to find people close enough and dedicated enough to organize with. Bent on taking action anyway, I decided to host my own Shell rally. I made flyers and put them up around my college campus and some coffee shops. I emailed and called local news stations to invite them to the rally. I called the local police station and asked questions about laws regarding protests — on the day of the rally, our group was actually approached by two police officers who came to offer their support and gave us a number to call if anyone bothered us. It was during this planning process that I was invited to apply to be a Greenpeace Group Leader, and saying yes was one of the best decisions I’ve ever made. Now, I organize in my community — that same community that seemed so complacent to me — regularly. Organizing has shown me that politicians are not the only people with the power to change the world, and that is heartening. It’s incredible to know that abandoning my one-time dream of becoming president does not mean abandoning my desire to change the world.

I joined more than 200 people who organized across the country to celebrate the first anniversary of the world’s largest climate action to date. As I marched with my volunteer group through downtown Huntington Beach, passerby were cheering us on and even joining us. Many people cheered and clapped for us, some people just stared and only a few responded negatively. We met cries of “get a job,” with “get a clue!” It was amazing to stand with 25 people from my community to fight against climate change, and it felt just as amazing to stand up to the people who told us to give up. I’d never seen this type of activist spirit before in my hometown. It made me think that maybe there are more potential activists in my area than I realized. After the march, a woman who came with children told me that her “kids and their friends learned a lot. For one: that they can make a difference by raising their voices.” It was an honor to pass a culture of activism on to a younger generation. And maybe that’s the way we can start to make a change, by educating the next generation and preventing them from repeating the mistakes that destroy our environment. Those kids are an excellent example of why grassroots organizing is so valuable and so important — whatever changes I try to make on my own will be amplified by the culture of activism I am starting to build in my community.

Google is testing a new loan interactive calculator for car payments. This was spotted by both Dr. Pete Meyers and Kyle Sanders recently. It looks and feels a lot like the Google mortgage calculator feature that Google launched in February of this year.

I am personally not able to replicate this, but here is a picture from Moz :

As you can see, you can enter the loan amount, the interest rate and the period of the loan, and then Google will show you your monthly payments. You can also toggle to see the maximum loan amount, as well.

Will we soon see car loans through Google or maybe a way to buy, lease or finance your new car through Google Comparison AdWords Ads? Maybe?

    To successfully sell your car in Georgia, you and the buyer will need to sign off on several documents:

Before selling your vehicle, find out how much it s worth by checking its Blue Book value. It may be worth more to you than to anyone else, especially if it s older or in poor condition. While you re checking the value of your old car, consider looking up your next vehicle, as some cars depreciate much more than others.

    Here are some other tips to sell a car back to the dealer.

    Ensure that all routine maintenance has been completed and recorded. Top up all the fluids, including oil, transmission, antifreeze, brake, and windshield washer.

    Clean the car thoroughly both inside and out. Fill any scratches and repair any dents that can be pulled using a paintless method. If there are scratches or cracks in the windshield have them repaired. Try to remove any stains and fix any tears in the upholstery. Remove all personal items from the vehicle, and ensure that the owner s manual, jack, lug nut wrench, and any other items that came with the car are still in their proper places.

    Ensure that the tires are in good shape. If not, consider purchasing new (or used) tires. If you have an extra set of rims, check to see if they will fit your new vehicle before including them in the sale.

    The standard tariff for importing cars to the U.S. is 2.5 percent of their value. For pickup trucks and commercial vans, the tariff is a whopping 25 percent. Individual European countries don t charge import duties, but the European Union charges a flat rate of 10 percent on imported automobiles. In simple terms, tariffs are taxes. They re paid to governments by the businesses that import and export products and are factored into the prices we pay. Virtually every country in the world charges tariffs to some degree. With the proposed TTIP in place, the tariffs on cars and about a billion other products exchanged across the Atlantic would almost definitely disappear.

    Though online shopping has become ubiquitous in recent years, buying a new car remains a distinctly retro experience. However, a new initiative by General Motors may eventually make a visit to the local car dealership obsolete.

    Throughout the year GM has been quietly piloting a new online service through which people can buy cars from local dealers via the Internet. The initiative, dubbed Shop-Click-Drive. is currently being tested with around 100 dealers around the country. Through the website, customers can browse new cars, obtain pricing quotes, select add-on features, apply for financing and confirm a purchase. The dealers will even deliver the new car to a customer’s driveway. The program, which has generated 900 car sales so far, will be available to all 4,300 GM dealers in the U.S. by the end of the year.

    “There are some dealers out there who are Internet savvy and enable consumers to do a lot of the experience online,” says Ryndee Carney, manager of cross-brand communications for GM. “What’s different about Shop-Click-Drive is that consumers can virtually complete the whole transaction online all in one place.”

    Ninety-four percent of consumers globally research cars online before they buy, and about a third would be willing to buy a car over the Internet, according to an annual survey by consulting firm Capgemini. GM says their online initiative is particularly aimed at attracting Millennials, who spend much of their time online and are driving less than their predecessors. Purchases of cars by young people took a particularly hard hit following the recession but recovered somewhat in 2012, when Millennials bought more than 1.2 million new cars, according to data from auto research firm Polk. A push to online sales could help encourage even more young people to become car owners.

    “This sort of evolution of use of the web in the industry has been going on for quite a while,” says Tom Libby, a senior forecasting analyst at Polk. “It’s in a seller’s best interest to take advantage of this trend.”

    Some dealerships may be wary of offering online sales, as it could hamper their ability to sell customers additional features in the store. It’s also more challenging to cultivate loyal clients if customers are interacting with a computer instead of a human being. On the other hand, online sales could lure in a group of buyers who are looking for a straightforward shopping experience instead of the drawn-out process of visiting a car dealership and haggling with a salesman.

    “The dealer might actually make slightly less money per unit  using this new process but because their volume’s gone up, their overall profit has gone up,” Libby says. “From that standpoint it might very well help them.”

    GM is quick to point out that the online sales are not intended to circumvent the independent dealerships that carry their cars. State laws around the country protect dealerships’ exclusive right to sell new cars to consumers. Attempts to get around such laws have met resistance in the past from dealership coalitions that lobby heavily to influence state and national legislation. In 2000 Ford attempted to market its used cars online, but the effort met resistance when the Texas Department of Motor Vehicles said it violated state law. This year Tesla has been banned from opening its own dealerships in a variety of states (including Texas) on the grounds that car manufacturers cannot sell directly to customers.

    “A manufacturer cannot just arbitrarily say, ‘This is the way it’s going to be,’” explains Libby. “It’s a two-way street. The dealers have some leverage and some power. Even though this process is done online, there’s still a lot of power in the hands of the dealer.”

    GM isn’t sure whether dealers will flock to online sales en masse. Of the 900 cars sold through the website so far, only five have been sold to customers through an online-only process. Many drivers still want take a car for a test drive before making a big purchase, and dealers must inspect trade-in vehicles if they are part of the transaction.

    But the option is now there to buy a brand new car from the comfort of your living room. Other car manufacturers are no doubt watching to see whether the habit takes off.

    “If it works, we could see this spread throughout the industry,” Libby says, “but in the near term we just have to wait and see how it works.”

    The late 60s produced some really incredible cars. It was an era when the Ferrari 275 GTB/4 and the Lamborghini Miura were breaking production car speed records and ushering in the era of the supercar. But, these cars weren t how the makers of exotic Italian machines were making their money it s something we sometimes forget today, but it was bigger 2+2 touring cars that were the bread and butter of high-end Italian sports car market at the time. Lamborghini was a bit late with its offering in this niche, but most would agree that it was worth the wait.

    Lamborghini s first 2+2 was the Espada, named for the Spanish word for “sword.” It was one of the more indirect references the company would use to bullfighting, but it still counts. Like the Miura, it offered outrageous styling, although the design was different enough to not look derivative. It also offered a ton of power and class-leading interior space. It should hardly come as a surprise that it became Lamborghini s best-selling model for years to come. The car was tweaked several times over the years, and there are three different series of Espadas, but the biggest change from one to the next was always the interior design.

    Auto Express investigation: used car dealers are hiding the history of ex-rental cars in a practice slammed by Trading Standards

    Car dealers are keeping quiet about the ex-rental history of their used cars, despite legislation banning that very sales practice.

    An investigation by Auto Express has revealed that most car manufacturers do not insist their dealers pass this information on to potential buyers, while Britain’s largest dealer network has argued that it would only supply the information “if asked”.

    Under Consumer Protection from Unfair Trading Regulations (CPUTR) 2008, it’s illegal to withhold any details that could affect a purchase decision about a car at the point of sale. Advertising a car as having one previous owner, which later transpires to

    be a rental company, is a prime example of this practice, according to Office of Fair Trading guidelines for the regulations.

    This kind of misleading omission could land a dealer in court, facing hefty fines or even jail. But when Auto Express quizzed all the major car manufacturers about this sales method, 83 per cent said they did not insist their dealers specifically flag up ex-fleet, ex-rental or ex-driving-school vehicles to potential customers.

    Audi UK even argued dealers were “not legally obliged to do so,” in response to an Auto Express investigation into one reader’s complaint about this practice (see the case study below).

    Many argued that the information was already listed on the logbook – even though the car’s usage may not be obvious and customers might not even see the V5C form until collecting it – while others said dealers would only supply the information if asked.

    Manufacturers also unanimously argued that the quality checks needed for a car to be granted approved used status meant that an ex-rental history was irrelevant.

    Dealer group Pendragon, which sells 100,000 cars each year through its Evans Halshaw brand alone, agreed. Its spokeswoman said: “Revealing that a car is ex-rental or fleet could be misleading and might put people off.”

    Trading Standards says rule-breaking is rife in the used-car sector, with complaints from car buyers making up almost 75 per cent of calls received by Citizens Advice each year. However, Trading Standards’ motor trade expert Gerry Taylor admitted: “Severe cutbacks mean we simply don’t have the manpower to enforce these regulations.”

    A car with just one previous owner is every used buyer’s dream. But what if that owner turns out to be a rental company? You’d probably feel misled.

    That’s certainly how reader Leigh Caller of Yeovil, Somerset, felt after buying his approved used Audi A1 Sportback. Leigh said: “Three weeks after buying it, I received the V5C and was shocked to discover the previous owner was Hertz UK Ltd. I wouldn’t

    have bought the car had I known it was anything other than a one-owner vehicle.”

    When he complained, Leigh says Yeovil Audi argued he should have asked more questions at the point of sale – but the law says he didn’t have to. If a dealer fails to divulge information at the point of sale that could affect your purchase decision, it’s committed an offence under the Consumer Protection Act from Unfair Trading Regulations 2008, and could be prosecuted.

    Yeovil Audi agreed to give Leigh £500 as a goodwill gesture, but he was asked to sign a disclaimer stating the money was not an admission of guilt from the dealer .

    We contacted Audi and were told the dealer had not broken any laws. Its spokesman told us it was sorry Leigh felt misled, but ad ded: “We do not require our sales staff to specifically draw

    attention to ex-rental stock, and they are not legally obliged to do so.”

    We disagree, and reported the case to Trading Standards. Its lead officer for the motor trade, Gerry Taylor, confirmed: “The dealer is legally obliged to draw attention to ex-rentals. Failure to do so could mean prosecution.”
